I received a letter from Afni 11/8/07. Worried about our credit I called these people are nasty human beings, how can you sleep at night? Shame on you. I was treated like a low life, I tried to explain that we must be victims of fraud and they refused to listen to me or take my dispute. They are claiming that I owe them $651.58 from Verizon, Florida from 1997..yes, that is right 1997!! Why if this is mine has it never showed up on my credit report, why hasn't Verizon made any attempt to contact me. Not once! After getting degraded I had to hang up on them, I have never been treated so horribily by a person in my life. Trying to calm down I tried to call again to see if another individual could help me, but apparently they noted my account, asked me how long I was married to my husband. I explained we never lived in that location and that someone must have illegally used my husbands name. Again, I had to hang up the phone, they were trying to make me admit to it being my bill and trying to collect money from me with a credit card and I hung up again. OMG...I called my husband in a panic, what is going on here. I decided to look up the word "AFNI" and sure enough I see this website with hundreds of people trying to be scammed the same way we are. So thank you to all of you. At this point I was furious.
I called back to tell them that what they are doing is illegal and fraudulant and that I was going to report them to the Federal Trade Commission and File a complaint for Unfair Debe Collection Practices. Also that there are over 300 complaints of Bogus claims to collect money from innocent people. Not to mention there is a Statue of Limitations (each state varies) but it states that A Creditor or Debt Collector give up his right to file sute to collect a debt after a period of 5 years from the time the debt was written off or from the date of last activity.
The purpose of these statutes of limitation is to bring some measure of fairness to the debtor so that he / she (1) will not have to worry about being sued for the rest of their lives; and (2) so that the debtor can properly defend himself with fresh evidence and witnesses, if any.
This doesn't mean that a creditor cannot file suit against you after the statute of limitations has expired; however, if a creditor or debt collector does file suit, you can ask the judge to dismiss the suit on the grounds that the statute of limitations has expired. In fact, if the statute of limitations is about to run on debt you owe, don't be surprised if you suddenly hear from a collection agency threatening to sue if you don't pay immediately.
If a debt collector contacts you regarding an old debt, do not admit that you owe the debt and do not agree to make any payments. Simply tell them that the "statute of limitations has run on this debt and do not contact me again". If they continue contacting you, send them a certified letter, return receipt requested, telling them not to contact you about the debt again. Remember -- DO NOT ADMIT THAT YOU OWE THE DEBT, DO NOT AGREE TO PAY THE DEBT, AND DO NOT AGREE TO SEND ANY MONEY TO THEM. If you do, then the statute of limitations might start running all over again, giving them the legal right to sue you.
Although I am an Innocent Victim and do not owe this money. The law protects us from these people trying to collect money for over a period of time. So DO NOT SEND ANY MONEY, DO NOT ADMIT TO ANYTHING, BECAUSE THEY WILL TRY TO COHERSE YOU TO ADMIT TO IT.
I have filed complaint with the Federal Trade Commission and I am hoping everyone here has done that because there is a VOICE in NUMBERS!! I have sent them a Certified Letter with the Statue of Limitations, That I am disputing the fraudulant claim, and to NEVER CONTACT ME AGAIN.
Good Luck......DONT' BE VICTIMIZED!! I'M NOT GOING TO LET THEM VICTIMIZE ME. IT'S ONE THING IF YOU OWE THE MONEY IT'S ANOTHER WHEN YOU ARE INNOCENT.
