I received a letter from AFNI for a Qwest account from 6 years ago. I believe I paid the bill. Per the great advice from this forum, I sent them a certified letter disputing the debt, and asking for validation. About 1 month later, I received a letter in response.

It states in part: "The final resolution of the disputed account has been delayed due to insufficient information provided. Afni requests additional information so that we may conclude the investigation." They go on to ask for the specific info I dispute, and the basis of my dispute, and a copy of my drivers license or receipts, and my phone number. They provided absolutely zero information that I asked for.

I'm guessing that they have nothing, and our obviously fishing. How stupid do they think I am? But what do I do now? Aren't they required to validate the debt within 30 days of my letter to them? Obviously they did not. Do I ignore them now? Do I send them another letter saying they owe me information, not vice-versa? Do I file a complaint?

It's not your job to validate the debt...it's AFNI's.

Send a letter via Certified Mail + Return Receipt to AFNI stating:

It is not my job to validate debt. It's the responsibility of the debt collector upon receipt of an offical request per the Fair Debt Collection Practices Act . Your firm has damaged by credit rating with your posting of damaging info on my credit file for a debt that I do not owe.

Per the Fair Debt Collection Practices Act, I am requesting written validation of this alleged debt. Remit the following as validation:

- a copy of the original application for this alleged debt which shows my signature
- verification of the original Date of Deliquency for this alledged debt
- verification of the Date of Last Activity for this alleged debt

Either validate this alleged debt or remove it from my credit files. If this notation is not removed, I will have no choice by to take legal action per my rights under the Fair Debt Collection Practices Act. Receipt of this letter is being time-stamped by the USPS. I will also file reports with the Attorney General of Illinois if this bogus notation is not removed from my credit file

This alleged debt from AFNI is not mine.

Per the Fair Credit Reporting Act, I am requesting:
- written communication between Experian and AFNI that led to validation of this alleged debt
- I am requesting copies of signed contracts proving that I own this alleged debt.

This letter is has been sent via Certified Mail + Return Receipt and is being time stamped. If I do not receive a response within 30 days of receipt, I will interpret this as a refusal to document the validation of this bogus debt and I will have no choice but to take legal action per my rights under Fair Credit Reporting Act.
