I had my first experience with allied interstate was about a year ago when sears hired them to collect a large debt from me. My total debt ranged around $2800 at the time. I arranged payment with them and payed about $1200 in a few months. After that, I was layed off and notified them that I would only be able to pay $150 a month and agreed to let them take the money out of my checking account on a weekly basis. They did that for a few months and then I noticed that the money was no longer coming out of my account. That went on for three months until one day they called me at work claiming that I only owed $480 to close the account. I told them I would pay it in the next couple of months but was only able to pay half. After that, they stopped contacting me altogether until 4 weeks ago when I received a letter threatening legal action and stating that I once again owed the full $2800. I didn't see how this was possible and so I sent a letter to them via secured mail stating that I would gladly make payments of at least $200 a month until the debt according to my records is paid in full. I have been sending money via priority mail every friday. I also stated that they weren't to call me at work under any circumstances and I am in the process of moving, so I don't have personal phone service. They still call work several times a day, although I have proof that they received this letter. My supervisor and myself as well as several other people have told them we wouldn't accept their calls at work, but they still keep ringing the phone off the hook. I stated to them that because of my situation, the only way to reach me is by mail, but they haven't sent a letter since the last one I responded to. They also call my father and harass him a couple of times a night wanting to know where I'm at. This has to stop. I keep pretty good records, so I know for a fact I don't owe this much money and I know that once I tell them not to call me at work, they can't. The last time I checked, it isn't illegal not to own a home phone either. Maybe I handled this wrong, but I have no intention of letting an un-paid debt go unsettled. However, the constant harrassment is making it harder to solve. I know what I owe, apparently they don't. Any advice would be helpful from anyone out there. thanks

#4 Consumer Suggestion
Send them another letter.
AUTHOR: Mike - (U.S.A.)
SUBMITTED: Tuesday, September 07, 2004
You need to send another certified letter with several specific points in it. First tell them a "limited cease and desist". They are not to phone you at all but they can still write. List out all the numbers they have been calling and say that, in particular, they are not to call those numbers. They cannot use the "attempting to locate you" excuse to call relatives because your letter has your address on it. Do NOT talk to them on the phone under any circumstances. They are trained to deceive you. Any agreements made over the phone, since they're not in writing, will not be honored. (A place like Allied Interstate is unlikely to honor agreements in writing either.)
Certified letters can be sent to a PO box. The post office will put a card in the box telling whoever picks up the mail to go to the counter and sign for your letter.
Also in your letter demand that they validate the debt, i.e. account for the exact amount owed and all the payments you've made. Do not admit anything. Do not tell them anything about your identity or your finances that they don't already know. Just because you've paid on a debt does not prove it was ever yours in the first place. The burden of proof is totally on them and they can almost never provide it. Do not pay any more unless they have enough validation that it would stand up in court if they went to sue you. They will not.
Since you have a good history of paying them, they're just pulling numbers out of their a** at this point to see how much they can get. Watch your bank account for unauthorized withdraws. Which would be any withdraws at this point because your letter also has a part revoking any authorization they may have had to draft money from your bank account(s). Show a copy of the letter to your banker if there are any problems.
At this point you are generally better off not paying the debt. If they cannot validate it, you have no legal obligation to. Sears sold the account to Allied for probably less than $50.00, and Sears will not get any more money no matter how much you pay Allied. Paying will not improve your credit rating, it is just a waste of money. And look at the kind of people you are giving money to.

Let me clear up some things
AUTHOR: Jason - (U.S.A.)

I wish to clear up some things that I failed to mention. First of all, I did not send anything to a p.o. box. At the time I was writing this article, I did not have access to any of my statements containing the mailing address, so I used one I saw posted on the net. That's my fault for not looking into it. And as far as Allied not collecting for a sears account: The billing address being sent to me is most definitely in Colombus Ohio.
Maybe the billing address and the address of the company holding my account is different, I don't know. One more thing, according to the FDCPA, if a letter is sent telling bill collectors to cease communication, then their employees are prohibited from calling you, period, except to let you know that either collection efforts have ended, or the account has been submitted to the original creditor for possible lawsuit. I'm not attempting to argue here. I just needed some advice. I do not appreciate the overly rude rebuttal to my last article, obviously posted by a bill collector. I'm just looking for sound advice.
Mocking me by making comments about my "daddy" and such will not be read, so don't even waste the time typing if that's all you can come up with.
thank you

3.) record yourself and them when they call you at work and tell them no more calls to poe. otherwise... oh darn we didnt know we couldn't call.
4.) im sorry fo the calls to daddy... but if you ever talked to them from there they can claim they believe this to be your home number and can continue to call... no ifs no ands no what abouts... that is not breaking the law... They may personally know you dont live at that number but i gurantee it is documented that you have used that number.
