Approximately 5:00 p.m. on 11/08/2005, I contacted this agency regarding my wife's and our request that we were declaring chapter7 bankruptcy and told the gentleman (forgot his name) that my attorney requested that any further contact be sent to her office, and not to me.

Well, he proceeded to curse at me and threaten me, and even told me that my wife and I were unable to file bankruptcy, and that our cased would be dismissed. I told him that I simply wanted to give him the address to our attorney, and he started cursing and said he would call our "Ambulance Chasing" attorney and see for himself.

He also told me and my wife that we just needed to pay them and stay in our trailor. He said that they would take our cars and when the court dismissed our case, he would sue and get "all he could get" from us.

At this point, I advised him that he just broke one, if not two of the Fair debt collection practices laws, and he said I wasn't smart enough to prove it. He also told me that he would call 2 times a day, even on sundays until the debt was paid.I told him that this was fine, cause I could just change my number, as harrassement was uncalled for. He also told me that his company doesn't have to abide by the bankruptcy court's stay, and they will and can protest this debt, even though capital one had no problem with us declaring bankruptcy.

In then end, the collector was getting so loud and berating that I just hung up on him. I then called back and relayed all this information to a supervisor, who was very nice, and she apologized and said that the collector that called me had several complaints already today, and this wouldn't happen again.

Did they break any laws? Is this level of harrassment expected? Just wondered if I did the right thing.

Think hard before filing chapter 7!!

AUTHOR: Steve - (U.S.A.)

POSTED: Sunday, January 15, 2006

That is usually the worst 10 year mistake you can make, and unless you have property to protect there is really no reason to file a chapter 7.

Don't let some lawyer sell you on the idea, get some impartial advice if possible. Check the laws in your state on criteria for wage garnishment and property siezure.

You might be suprised.

Also the statute of limitations may be up or close to it, so the debt may not even be collectable by the courts.

I do know for a fact that any bankruptcy screws you for a long time, and IS NOT a "fresh start" as pitched by the bankruptcy attorneys.

Do your homework!

Filing Chapter 7

AUTHOR: Mark - (U.S.A.)

Never call a collection or card company. If they call you hang up. When you file Ch-7 or 11 the attorney you have does the necessary paper work for you.

AS TO COLLECTIONS. If you did not tape the phone call there is not much you can do, these people are paid to harass you. Here's some power. I had 4 cards (CREDIT) that went unpaid due to me being a DISABLED VETERAN. Then I went to www.bigclassaction.com and found that the same 4 cards were in federal district court for fraud. So that was a done deal cause I was in the same time period of the suit. The credit bureause refused to read my paperwork so I filed a suit with them through the Attorney's General of Texas that got them off their you know whats.

I suggest if you read try to find a book that was published called BACK OFF , it was written by a TV person who fell into traps about credit and shows you how to fight them back at every turn. IT WORKS OK, I know cause I was able to screw the card companies back with their own tactics.
