This is being filed two years late due to my having to go through a 2 yerar treatment for breast cancer. I am jsut starting to catch up on all that I missed and happened within the two years of my being so sick.

Back in November 2016 we found a leak that had apparently being going on for some time but we did not know this.  I saw a purple spot on my vinyl kitchen flooring and called about 30 companies asking if they could tell me what the purple spot was and no one could help me.  I was able to feel back behind the fridge and it was totally dry and was able to look back behind there and saw nothing.,  This continued and the purple spot spread. One day I saw that the purple spot was spreading to the shower which is behind our kitchen where the puirple spot was and that was when I became worried.  Never at any time did I ever see any water.  

I then called a plumber to ask him if he would come and move my fridge because I was unable to roll it forward and when he did there was black mold everywhere the eye could see.  This was the same fridge tha came with the house when we closed on it back in March of 2011 and the fridge was new.  About two years after we moved here we were having trouble with the icemaker and the fridge was vibrating all over the floor and making terrible noises so we finally turned off the icemaker to get the noise to stop and could not understand why a new fridge would have an icemaker go out so fast but that vibrating noise was deafening.

I was going through chemo at the time I saw the horrible mold and it made me immediately sick. The plumber ran from our house and told us good luck and told us that we need to call our insurance company.  I only wanted out of our house due to the extensive damage and called Mr. Arnold and asked him if we are covered for mold damage.  He said this:  Do you want to file a claim?  I stated that I only wanted to know if we are covered for mold damage.  Mr Arnold asked:  Do you want to file a claim?  I stated No that I wanted to know about mold damage.  

He again asked "Do you want to file a claim?  I repeated myself again and he for the third time asked me:  Do you want to file a claim?  I told him that if I have to file a claim to find out an answer then I guess I will have to file a claim.  He would not give me any answer to my mold questions without me filing a claim.  I remember it like it was yesterday.  All the while I am getting sicker.

After that the Overland Park Kansas Allstate claim department people who took the claims called me and I had no idea of where the damage was or what it was coming from since the bathroom was behind the kitchen.  I did not know if we had a leak in the bathroom or the kitchen.  The Overland Park Allstate men told me on the phone that Allstate would not cover a water leak????  Now they are supposed to just take the claims and do not rule on the claims.  Then We took a lot of pictures of the mold.  Then Overland Park of Allstate told me to CLEAN the mold with Clorox?????

I told them I am going through chemo.  They again told me to clean the mold so any adjuster they would send would be able to see any leak.  I had about 8-12 inches to climb through between the fridge and the cabinets and I continued to squeeze through the small space with an even smaller space in the back where I was trying to clean and tried to wipe those pipes down by spraying with Clorox all the while having to stop to vomit. The fridge could not be moved as it was literally falling through the floor. 

They told me it would be 2-3 days before they could get an adjuster in here. I asked them to get me out of the house until the adjuster gets here becuase it was making me sick.  All of a sudden they found a guy our agent knew who works for Allstate in Springfield MO who came here then to all of a sudden to look at the damage. This guy came and he did not go look at the pipes, nor did he go under the house nor did he go into the bathroom where the leak was located..  

The first thing he did was use our bathroom for personal use.  Then he stood at our kitchen sink, looked across the room at the pipe of the icemaker crossed his arms and kept them crossed as if we were inconveniencing him and told me that the icemaker had not been screwed onto the coupling the right way.  I told him that I probably knocked everything loose by squeezing back into that small space and by trying to clean it because I definitely did and I had my hands all over the black mold in trying to clean it as Allstate asked me to do which I thought was wrong.  His words as he stood at our kitchen sink with his arms crossed were this:  WE do not cover water leaks.  I told him to get out of my house and he is not proper representation because he is not a homeowners adjsuter.  

Since I was sick from breathing mold we had to let someone in fast who could fix this and we ended up tearing out three rooms of drywall, pulling out all the kitchen cabinets, replacing the toilet and all the flooring in the kitchen, closet and the bathroom,  We did very extensive work because the holidays were coming and we had no other choice since Allstate would not place us in temporary housing until it was done.  The workman worked on this day and night until it was finished.  It cost us about $30,000 to replace everything that needed to be replaced but we could not afford to replace the fridge which we still have to this day and the fridge was sitting right in all that mold.  Since we cannot see under the fridge we do not know the damage it may have caused to the fridge.  

After the workers left and the work was finished I read my policy and Allstate should definitely had paid for those damages.  We have a relatively new home that has been built well so since the fridge was already here when we bought the house we never pulled it out to check for water leaks not did we at any point ever see any water.  The water had leaked into the OSB board and sat under the vinyl flooring and had spread over who knows how long becuase I have no idea of how long the leak was there as we neer saw any water and there was never any indiucation of water other than when I started  seeing purple in the bathroom shower and that was when I knew we must have a larger issue that a stain on the floor.  I had thought the stain was from Easter egg dye that the lady who lived here before us used when she dyed eggs for her grandchildren since it was right next to the stove and the stove and the fridge were within 18 inches apart.

We now have a claim showing on our policy that I would never had wanted there and never wanted to start with just to answer a question.  I feel as though my rights as a policy holder were denied due to my having to text pictures to the claims department in Overland Park, Kansas who was not here so they did hot know what had happened. They saw the damages over a picture but they did not know the paerticulars.  We were denied our right to find a claims rep of our own of which we had to do with a tornado claim that Allstate underpaid on one year before that.  

After we found our own adjuster was when Allstate sent another person who finally wrote us a check for the proepr anmout on the torando claim but then Allstate back then aoso did not tell me that if the claim on the tornado was fixed in time we would get back money and one ever told me this.  We lost money on that claim also.  We had to pull the men off fixing the tornado damage claim in order to fix the mold damage because the mold was more important at the time then the tornado damage.  Then we had to pay out of our pocket over $30,000 for all the damages inside our house from the damages inside our home.

Allstate claimed that since the icemaker was not screwed onto the pipe properly they would not cover the claim but I never saw that because I was too busy scrubbing the pipes and since that was where the mold was the worst where I scrubbed the most so I most likely knocked the pipe loose when I was scrubbing and spraiying the clorox that Allstate told me to do.  At any rate this was not done by any fault of ours but we think when the fridge was vibrating if that happened then was when the pipe was knocked loose unless I did when cleaning the mold as Allstate told me.  Aside from that if this fridge was here when we closed on the house and our house was USDA inspected the leak could not have been there when we bought the house.

Allstate should never tell any customer to clean up before any adjuster gets there and we were also denied an adjuster since this guy who came owned an office in the Springfield, Missouri area.  He was no adjsuter but only traveling to Joplin form Springfield so they told him to come by here and look at out claim.  We were denied a proper adjuster.  This man looked at nothing but only stood there and glanced at it all and told uis they will not cover it.  They would not cover it because they knew the claim would cost too much out of Allstate pocket so that is why they denied it. They surely did not hesitate to charge our policy for a claim they did not pay though.

The way we were treated by this claims process is not acceptable.  There is no way we should have bween treated like this and definteily not told to clean it up before anyone got here to look?  I want Allstate to tell me why this happened and what their LEGITIMATE reasoning was for their denial and tell me why they would tell their customer that we have to clean up the mold damage before they would send someone to look and why we were denied proper adjuster response and qualifications as such.  Their claim dept in Overland Park also denied the claim over the phone????

Allstate screwed us on this claim and everything they did was wrong on this claim.  Now they have us showing that we have a claim on our policy that they did not pay on when that should never have happened.  All this happened within 8 hours and the letter of denial was sent to us in less than 30 days.  The letter of denial shows a stupid reason for a deniual when we were not represented.  This was a true enmergency and they way Allstate and my agent handled it was reprehensible and totally should never have happened.  I would adviuse everyone who has Allstate to READ your policy no matter how much time it takes so you will not be screwed as we were at at time in my life when I was fighting for my life with cancer.  To be treated this way is more than wrong.  

Better idea == Get rid of Allstate as your homeowners insurance provider.  You can do much better with another company.
