We have had numerous hail and wind storms here. Every house in the neighborhood was damaged. Allstate came out sent someone on the roof while I was not here, I told them I was to be here. They refused the claim. I had 2 roofers come and look at the roof and tell me there was damage before I even called them. I then asked for a re inspection, they again came by while I was not here. Again refused it. I complained to the insurance commission of NC they always take the companies side as I have since found out. All but one of the houses have a new roof in my area.
They paid us for a closet ceiling that was water damaged they said from wind/hail damage but said there there was no wind/hail damaged. But our policy say's we are not covered for water damage.The second time they came by the guy from Allstate said the first person should not have paid for that. We were then cancelled.

Same old thing on tens of thousands of hail claims. You can hire an Advocate or Public Adjuster and force them to appraisal. Demand Appraisal is one of your contractual clauses under Section I Conditions of your policy that you or they can defer to when property damages are in dispute. In fact its required precedent to any suit.
The appraisal process can cost you $2000-3000 max if by legitimate Public Adjusters and Umpires. I took Allstate to Appraial 16 times on hail roof claim denials this summer and won each one. You have to use a veteran adjuster on your side who know the ropes, not a contractor. You have to file for retail value of the roof, not a sub contracor roofer bid,to make it worth the cost. You can almost always win 40% more than your cheapest bid. You do not have to settle for cheap bid repairs to get a claim paid. Knowing who is who in the industry is key to winning at an appraisal as all the insurance contractors and engineers (Doan/ Haaig) are not impartial as they are paid well by Allstate. Dont allow them to use their pet vendors agaisnt you.
Hail is tricky as they claim bruising or light hail is not coverd unless you challenge them. Light or heavy damage is still damages under the terms of the contract. It has to be damaged by a covered peril (hail) and to covered proeprty (house), then there is no coverage issues, its covered. The issue is damages which is subject to Appraisal. As for age or conditon its absolutly not relevant if you have Replacement Cost Coverage. You paid for New for Old when you have a loss. They are entile to pay the depreciated value until you make repairs though. So the condition of old age wear- tear shingles is not an issue. They wrote it in its condition and collected your premium, they owe for old damage as well under the RCV clause.
Their claim protocol is for up to 3 claim inspections (State Farm allows only 2 ) for each denied claim. The claim costs is already factored in with your premium when paid whether you have a claim or not. Its non sense to think they will be upset that you made them come back 2 or 3 times, thats their claim protocol today to avoid the appearance of bad faith.
We have found this year that they follow the 1970 idea of "when in doubt on questionable claims, "deny it first as you can always pay it later". That use to be the claim protocol decades ago that once again has surfaced.
File a demand for appraisal if you have light blemish hail damage to gutters, roof vents, screens, etc. The wind also lifts some shingles and they did owe for the water intrusion regardless if you have exterior wind damage or not under an all risk form. They paid that part right, bet it wasnt much money. Leaky roofs are covered for ensuing water damages regarless h*o wit got in, but the roof repairs are not if they are old chingles caused by wear and tear. Your hail damage is covered but for the ill skilled cat adjsuters (not real adjsuters) following the carrier guidlines to deny first and pay later if challenged. Welcome to all those denied in Sandy as the Insurance commissioners and congress are scrambling to change the laws forcing carriers to pay what they owe.

I do have to agree with you the insurance companies rule the earth. At least the US. I have been hearing horror stories since this has happened. The dont pay any claims not even personal injury claims.
And unfortunately the state is a waste of tax payers money. You can prove all you want to but they just tell you to find a lawyer, they do not even do anything.

From my experiences with insurance companies, a claim is more often then not denied because of previous damage to the roof. Im not saying a meteor shower needs to decimate your home before they will pay you. I am saying that if they have found that your roof was previously damaged, for whatever reason, and not DIRECTLY linked to the event you are claiming, they tend to deny the claim on that basis alone. WHY? You might ask. Its actually simpler then you would think. Because if your roof had no previous damages then they would have a good idea of what its going to cost to replace or repair. But if you have previous damages then they cant determine what part is theirs to pay.
Its the difference between replacing a few broken shingles and replacing the whole roof. Now they have the right to do an inspection at anytime when you place a claim. See they dont need you there to do their job. They CAN come onto your property and inspect your claim without you there. Its actually in your "Claim Processing" section of your insurance contract. You are asking them to pay for YOUR roof. They dont need you there trying to force extra sympathy from the inspector. Its a very common practice. Cry and plead mercy and hope that the inspector finds in your favor.
As for being cancelled, that too is also in the paperwork that you signed to get insurance. Its under the "fraudulent claims" section. You made them come out and an inspector determined that they couldnt figure out what THEY would have to pay due to previous damage. Then you have them come out again and inspect it. These inspecters get paid reguardless of whether YOUR claim gets paid. This means you cost them time and money on a claim they could not substatiate liability on. They then give you money that would not have normally been yours due to a lack of findings on your roof. So they cancelled you for multiple reasons.
I tell you this so you will be well armed with information if you chose to continue your fight. They will claim that since there was previous damages to the roof they could not determine their level of liability. They will also claim that since you wasted THEIR money on an inspector AND you recieved money for a partion of your claim WITHOUT a finding of liability, that YOU commited insurance fraud. This means that you are going to have a hard time getting ANY insurance company to protect your house for a few years. There IS a national insurance fraud database that you WILL be entered into.
You personally may not have been intending to commit insurance fraud, but thats what the insurance commision in your state is going to "see". You may be able to get your states insurance commision to reverse your insurance companies descion. But it is HIGHLY unlikely that they would. The insurance companies take a VERY dim view of ANYONE attempting to make them pay for something that they are not LEGALLY liable for.
