My fiance and myself refinanced our home through Ameriquest/AMC Mortage Services last year. Then my fiance found out he could not work at his present job (welding of heavy equipment) as he developed 3 hernias from lifting argone bottles, oxygen bottles, heavy plates of steel, etc. It took him until March, 2006 to finally secure new employment as a heavy equipment operator, whereby he need only sit in a seat and operate the machines and no stress on his hernias.

We thought, at last, we could catch up with our bills, only every other day this past spring it would rain, therefore, no work for him on the rainy days. Hence, very little income from him. Ameriquest would not hear of this. No payment plans allowed, "COMPANY POLICY" I was told.

Then, the inevitable happened again, my fiance was laid off due to the company not making enough money. Again, Ameriquest would not hear of this. Now, my fiance has his dream job, operating heavy equipment at a facility he absolutely loves, the co-workers are great, he is finally treated & respected extremely well. In the meantime, while we have been striving & striving to catch up financially, Ameriquest has been trying to take our mortgage payments out of our account, but to no avail, as the money needed to catch up has been going for some other bills. BUT, AMERIQUEST HAS been trying to take money out of our account WITHOUT OUR PERMISSION and now trying to charge us additional fees.

**NOTE** This complaint will also be going to the New York State Attorney General's office.

HERE IS WHAT RIP-OFF REPORT SUGGESTS YOU DO:

Go to your bank within 60 days of the charge, or as soon as you know about the charge, don't delay, and tell them that there has been fraudulent activity within your account. Explain that you wish to file a dispute, and demand that they assist you in accordance with Federal Regulation E.

According to the majority of victims interviewed by Rip-off Report, those who immediately called their banks to dispute the charges did not get very far. Many victims got the following responses from their banks: we could not do anything for you or you waited too long; it has been more than 60 days.

If the bank is says that you have waited too long, explain to them how you called their 800 number as soon as the charges were found, and were told by the bank that nothing could be done. Remind the bank that they failed to assist you properly at the 800 #, and instead, provided you with an inadequate explanation of your right to dispute. Tell the bank that it's their fault time has expired, and since they gave you the wrong info to begin with, they will just have to deal with it, take the loss and reverse the charges.

Tell them the truth; this was unauthorized and your account was NOT to be charged! Keep emphasizing how you never authorized anything! Direct them to the hundreds of victims reports that were filed on Rip-off Report.com. And if you're at the bank, walk them over to their computer and make them go to this site! If you are on the phone with them, tell them you will wait while they access this site! Either way, be persistent!

DO NOT TAKE NO FOR AN ANSWER!

Let them know nicely, that you were advised to Report them (the Bank) and this situation to the Banking Commission in your state. Since each state has a different name for the agency/controller over banks, find that name before you call or get to the bank so you can throw it in their face. The more knowledgeable you appear to be, the further you will get.

And just continue to demand the Federal Regulation E form! The bank CAN, MUST and WILL reverse the charge! But, you must be persistent; ask to speak to the supervisor or the area manager for all the branches in the state.

Let the bank personnel know you are meeting with the media later in the day, that you would much rather they do the right thing (as most other banks have) by looking at the complaints and immediately reversing the charge(s) to your account; no matter how long ago it was. Be sure to call the Media if necessary so you are telling the truth.

If you have to, be loud (but nice) in front of other customers. If you are just calling by phone, the above tactics should still work. The bank can easily fax or mail to you the Federal Regulation E dispute form.

CHARGES TO YOUR CREDIT CARD

If the charge was to your credit card (not debit card, check card, or checking account), contact the credit card company as soon as possible to request a dispute form. Consumers usually have a little longer to dispute fraudulent credit card charges (up to 6 months), but it is better to act right away. In this type of situation, credit card disputes are usually successful since fraudulent companies often won't contest the disputed charge. In rare cases, credit card companies will review disputes, but refuse to reverse the charges. If this occurs, complain to a manager and let them know you will be filing a report here.

Remember Don't let them get away with it! Make sure they make the Rip-off Report .. The more Reports filed on a Company or individual, the more likely it is that the authorities, media and attorneys will want to take action.

Genevieve,

I am truly sorry to hear about your situation, and unfortunately being in the lending industry, I hear about people's misfortunes all too often.

Have you considered the alternative?? Just because you are behind on your mortgage does NOT in anyway mean that you are STUCK! There are plenty of companies who are able to help consumers in Sub-Prime situations...Companies who do not have the marred reputation your current lender has.

Be proactive and GET OUT OF YOUR MORTGAGE! My company can work with people who are even 120 days late and have a sheriff's date set to foreclose on the home!

Whereas you may pay higher fees than a Prime customer, you would at least be able to get back on track with your home loan, and possibly consolidate any of the other credit cars, loans, etc. that are hurting you financially as well!

There are those of us in the industry that are out here to HELP people. Please let me know if I can help the two of you.

Angela ... if you have been reading these postings for years I would think you would have a little more compassion for the hardships some people have had to endure. I see you do not. I also see you have not experienced one yourself but that doesn't mean it won't happen at some time in your life so I wouldn't be so quick to judge others.

If you agree with Megligo, you must be of the same intelligence level as he is ... which is very low. You both have just responded with negative remarks that help no one at all so why even respond at all? If you wish to cut others down, go find a chatroom to play in. People in that environment welcome an idiot to chat with.

If an employee of AMQ can't put dinner on their table because a customer couldn't pay their inflated interest payment, well bummer. They can experience the same as the customers they screwed.

You, Angela, must be one of their lying reps. If you don't work there, you should, because you would fit right in, along with Meglio or whatever his name is. Why don't YOU pursue some training in compassion and understanding because you sure do need it.

Kay, I will always defend the screwed people of this rotten, filthy company. I quit coming on here for awhile also because I got fed up with comments from idiots. But, I decided to log on and found that this Meg person responded, in an idiotic way of course, to almost every posting on here.

For Meg with an "O" .... who are YOU to be telling people how to pay their bills? You do not sound smart enough to be counseling others so don't.

I was trying to just say is don't pass judgement on others hardships. I agree if one has a agreement with a mortgage co. to withdraw the payments, they do have the right to withdraw their payments. My thing was the comments on her hardships, Or maybe I should say in the way they were stated. If one has never gone thru that kind of hardships, It's hard to know how it feels.It's OK to give your opinion's, sometimes I believe we could be a little nicer on how we state them.

While it is the "American Dream", it is also a simple fact that owning a home is not for everyone.

I am sorry to hear of your misfortunes, these things befall each of us at one time or another. Your situation resulted from a lack of planning and saving, above all else.

It may be that you are not financially ready to own a home. If the lender keeps attempting to gain payment for the mortgage, and finding no funds available, you will likely find yourself packing up and moving. They will tolerate missed payments for a time, but eventually will foreclose.

I don't see the lender as being at fault here, as they are simply in business to lend and then collect money. A lender can go from being your best friend at signing to your worst enemy at the drop of a coin when a payment is late or missed. With secured debt it is worse, they have a hammer to hold over your head.

Everyone, before considering buying a home, should have at least 4-6 months of living expenses in an emergency account that is never touched except for under circumstances of loss of income.

You think I am being mean, but if this woman had gone to an objective financial planner, he/she would have said the SAME THING.

Just so you all know...

NEVER pay a credit card, water bill, car loan, or ANY OTHER UNSECURED DEBT - INSTEAD of paying your mortgage.

Your mortgage is without a doubt - NO ONE WILL DISPUTE THIS - the MOST IMPORTANT BILL TO PAY IF YOU ARE IN TROUBLE.

Dont worry if the credit card companies threaten you. Pay the mortgage, not the credit cards.

People see me as mean, yet they applaud people like Kathy for coming on here and spewing profanity and "standing up for the victims."

Do you feel enlightened by Kathy's calling me a d**k? Does that help you with future financial endeavors?

I give up. This website is not for reporting people or LEARNING how to make things better. It's a friggin pity party. Everyone sits around and WHINE because we got ripped off, instead of understanding WHAT happened and WHY, and learning how to combat it in the future.

I GUARANTEE more than half of these people will make the same mistakes again because they dont want to acknowledge what they could have done differently.

I stopped writing for a long time, because I just can't believe some of the remarks that come out of some people. I just couldn't hold back on this one. If you have never been a victim of Ameriquest. Your Kidding right?

I have been reading these post for years and I have yet to respond but today I decided I had to.

I completely agree with Meligo. Mortgage companies in general do not want to take your home. They typically are not in the business of paying court fees, and trying sell a home that is trashed. Generally lenders will see no profit and many will only sell for 65% of it's current market value.

Yes it is a horrible misfortune that you have had so many things happen with regard to your husbands job. But take a look at the bigger picture, many people have had much worse happen to them and lets just say half of Amc customers go on a payment plan or they just forgive you paying your payment (which I think most people on here expect) Then that could lead to the company not making any money for that month, in turn they can then lay people off because of your small problem. And thus it becomes a vicous cycle.

So my suggestion to you is suck it up and realize that many people now can put food on there table because you didn't get your payment plan.

Also why not go out and look for a job to help your husbands situation, oh I know because you have to continue paying your credits and not your mortgage.

So, Ameriquest wanted to take the money from your account, and you told them "No" because you had "other bills" to pay?

Tell me these "other bills" were investment properties, your second home, or SOME other secured debt, PLEASE.

PLEASE PLEASE PLEASE dont tell me you ignored your mortgage company so you could pay credit cards or water bills.

Do you know how much your mortgage history influences your overall credit score?

What about your children? In the event AMQ forecloses, are you going to tell your kids, "Sorry you have to leave your school and your friends, but Mommy had to pay the water bill."

And finally, DO YOU WORK? We hear about your husband's misfortunes, but it doesn't seem like there was a back-up plan. Did you expect your husband to have his job forever?

This is a classic case of NOT PREPARING for homeownership. And furthermore, banks ARE NOT in the business of doing "payment plans." They collect payments, and if they cant collect payments, they collect houses.

But of course you KNEW THIS before you took out your loan, so I will spare you the lecture, since you are incapable of listening and learning anyway.
