I had a credit card account that was charged off and sent to APEX collections and I had originally an agreement but when was unemployed I could not make payments so they called my parents home several times and were so rude that my mother was kind enough to set up a payment to help me. This is account that is only under my name no other account holder... however they pursued my family to the point that they just broke down and decided to help me out... My mother had instructed them to stop the auto payment in September however they continued to deduct the amount and then when my mother cancelled her bank account last month they called told me that I needed to pay. I informed them i was still unemployed I didnt have the funds they wanted to settle so again that week they called my parents and spoke to my father before 8am one morning and told my father they were going to sue me harrassing him.. again this is no one's account but my own... so I sent a letter which they confirmed received in the computer that states not to contact anyone besides myself on my account that my personal information not to be disclosed to anyone. and that same week the same rude rep called in the morning harrassing telling me that she was going to sue me and i apologized that i cant do anything i am still unemployed dont have any assets etc.. then she said well then we're suing your family.. and started yelling at me that she was going to sue my parents even though this is my account until the supervisor came on to the phone.

Anytime an original creditor sells your account to a 3rd-Party collection agency, you are automatically covered under the Fair Debt Collection Act, which is a federal law that governs the behavior of collection agencies.
Regarding their threats to sue:
- Per the Fair Debt Collection Act it is illegal for a collection agent to pretend to be an attorney or to insinuate that he/she is working for one when that is not the case. If they are REALLY taking legal action against you to get a judgment, you have the right under the Fair Debt Collection Act to speak with their attorney. When a collection agent threatens you with legal action, tell them that per the Fair Debt Collection Act you are requesting to know the full name of their attorney and his/her license number in the state bar association and that you would like to speak with him/her. If there is REALLY an attorney there, they are obligated to provide this info and let you speak with the attorney....If they fail to do this....their threats of wage garnishment are both fake and illegal.
- Per the Fair Debt Collection Act it is illegal to discuss your personal financial matters with 3rd-parties. They can only allowed to call 3rd-parties when they are unable to locate you....and the are only allowed to leave call-back messages when doing so. They cannot discuss your personal financial info with 3rd-parties. If they continue to harass your parents, have your parents tell them they are violating the Per the Fair Debt Collection Act and that they'll press charges.
I hope that you have a WRITTEN agreement with this firm for exactly how much is to be paid. NEVER pay a collection agency without a written agreement....otherwise they'll just keep harassing you forever.
NEVER, NEVER, EVER give a collection agency your bank transit and checking account numbers for auto debits...they'll create havoc with your checking account if you do. Also, no post-dated checks for wire transfers. Pay ONLY with USPS money orders.
Remember, collection agencies buy defaulted debt for pennies on the dollar...i.e. $50 for a defaulted charge-off of $1,000....Remember this when making any settlement offers.
