We were just barely getting our mortgage paid each month, but we were doing it. Then the Liberty Settlement Group contacted us about doing a loan modification. It looked good so we went with it and on 12/30/08 we hired the Arase Law firm to modify our loan. The advice given to us was "don't pay your mortgage payment because your loan is in mitigation and it takes several weeks to get a loan modified but everything is good, we work with your particular lender all of the time and get good results. What ever is not paid now will be tacked on to the end of the loan."
They were simply lying. I kept calling them and kept getting the run around. They kept telling me not to talk to my mortgage company because they (Arase law firm) were working with my mortgage company and our case was with a negotiator who was handling everything.
On March 29th I decided to call my mortgage company and see if anything was being done. They had been contacted by the Arase Law Firm on Feb 25, 2009 and they had told the Arase Law Firm that our loan could not be modified. The Arase Law Firm neglected to let us know. They just kept telling me that our case was in negotiations. Meanwhile, my home was being put into default and now foreclosure has begun.
The Arase Law firm told me I would get a refund. That was on March 29th when I called them and told them I had found out from my mortgage company that they could not modify the loan. Now when I call them I either get a guy named Tamas who says the refund will be sent but he doesn't know when or I get an answering machine and no one ever calls back. As for the Liberty Settlement Group, their number is no longer a working number.

You robbed and cheated them! If it is not satndard practise to advise clients to not pay their mortgage payment, why did you do it? Was the individual fired that did this. Apoligising for destroying the lives of people (or attempting to) doesn't cut it my friend.
You ripped off these people and you should pay for it. Although I don't know whether they lost their home or not, your actions are inexcusable. At the very least, you cost them more money and YOU should pay for it. YOU own the company, YOU are responsible!
Just like a lawyer, talk your way out of responsibility and blame others for your screw ups. Better yet, let's blame the desperate clients, YEAH THAT'S IT.

While I cannot speak to the specifics of a particular case or client because of confidentiality in the attorney-client relationship, I have spoken with the client in this case and explained the situation and challenges the firm has experienced and how we will be addressing their concerns.
The state of the real estate economy and the poor health of the economy in general has greatly increased the demand for work-out, loan modification, and similar services that the firm provides. The increased demand has created a large number of requests for the loan servicers/lenders. This has dramatically lengthened the amount of time it takes to successfully complete a workout plan as the servicers were not equipped to handle the influx of requests.
In the recent past, the firm could complete a work out for a client in 6-8 weeks. As such, the firm created a business model to successfully address the needs of each client and then respond to client service issues in an timely manner. The increased service completion time has had a detrimental effect on the firms finances as the model was based on a 6-8 week completion time. Completion times from the servicers now takes approximately four months after the submission of information. The increased time dramatically raised our costs of doing business. Unfortunately, this lead to a cut back in staff, and as a result the response time in customer service suffered.
I am aware of the problems we have experienced on the client/customer communication side. This situation is now being addressed through technology and staffing solutions on the client/customer service side. With the availability of these new resources we are developing new client services department to quickly address all client questions and reponses.
As a matter of policy, the Arase Law Firm does not advise anyone to not pay a mortgage payment. We let our clients know that many loan servicers will not work on mortgages that are current or those that are current are given the least priority.
Further, Arase Law Firm does not guarantee any particular result or outcome. The changing workout and modification policies of the lenders has created an environment where outcomes are not always certain. We cannot predict a specific outcome with certainty.
I've communicated my apologies personally to this client and do so to others who have experienced the stresses caused by this situation. I remain committed to resolving the issues that we facing on a business and personal level, and assure people that we will not be a company that "disappears" after undertaking a commitment. Whether through completion of service or other means, I take very seriously the fulfillment of our obligations.
