The following are letters sent to DES and to the County Attorney regarding
how they mis-handle and Rip-Off the people.

To the County Attorney regarding Az. DES:

I know that DES handles the collection of child support for
Maricopa County. But my question goes one step further. I contacted them over six months ago and requested that they do a child support modification for me as my ex-husband is over $20,000 past due on arrearages. They immediately sent out the Financial papers required to complete the modification.

I called regularly for five months, (they have record of
every time I called). I was continually told they received all the necessary info from my ex and myself and that the case was being reviewed. After five months of NO RESPONSE by them, I decided to visit the office. To make a long story short, my file was in the file room still, nothing done at all on the case. Come to find out the case didn't even belong in the office on
Enchanto Blvd., it belongs in the office at 43rd. & Olive. So I give them one week to transfer my file and I go into the office. They have my file by now...but, no financials from myself or my Ex. the caseworker in forms me that the file is missing alot of paperwork. So now that our financials that they cannot locate are over 6 months old we are required to fill out more papers. I realize that I am just another number in that office but I seriously think that it is the most poorly run organization I
have ever delt with. Maybe the money doesn't mean much to them but it does to me. My tax dollars pay those peoples wages, aren't they supposed to be working for me? On top of all of the above I requested a history of all of the money paid to me since 1987, when I divorced. They gave me 5 sheets of paper claiming that he has paid me over $22,000.00. If he has paid that money where did it go?

I never received half of what they claim. They claim a check for over $600.00 from IRS was sent to me, checks for $1000.00 and several different odd amounts. The list is inaccurate. I know that my ex-husband,has never had that kind of money to pay me. I want them to prove to me that I gotthat money. I calculated aproximately $14,500.00 in funds credited to my
case that I have never received. Please can you direct me where I go to have this case expedited. Any help would be greatly appreciated.

This letter was to Az. DES

Why does it take me to supply you with this information that you are supposed to be able to get according to the U. S. Department of Health and Human Services Administration for Children and Families, Handbook On Child Support Enforcement.

Reference Section II: Finding The Non-Custodial Parent

The Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA) has given us an important new tool for locating parents who owe child support. It requires State and National Directories of newly hired employees. Employers will be required to report their employees within 20 days of their new hiring to a State Directory of New Hires. The State Directory will report the information to a National Directory of New Hires provided by the Federal Office of Child Support Enforcement. It states you will have access to the following information:

Vital Statistics
State Tax Files
Real and Titled Property Records
Employment Security Agency
Public Assistance Agency
Motor Vehicle Department
Law Enforcement Departments
Records of Private Entities like Public Utilities and Cable Television
Companies (such as names and addresses of individuals and their employers as
they appear in customer records)
And information held by Financial Institutions.

Reference Section IV: Establishing the Support Order: Obligation

The caseworker will make every possible effort to identify the parent's employment, property owned, and other sources of income or assets. This information must be verified before the support order is final. Under certain situations, the IRS may provide financial information about the parent's earned and unearned income such as interest payments and unemployment compensation. The State CES agency now has access to financial institution data, such as bank accounts and credit bureau data, which may
provide information about employers and/or assets.

There are many other sections that I can reference that say you can help me. Need I go on? Why must I do all of the footwork? You are a State Agency being paid by my tax dollars. You have access to information I could not possibly get my hands on. Why must I settle for what I am getting, which is nothing. You have access to his income tax records for the past years that show how much he makes, but I am supposed to base my support modification on minimum wage because you cannot verify where he is working. Why can't it be based on his past taxes? He sure didn't take a job making less than he was at his previous job, would you? How does he pay his living expenses? He has to be working somewhere.

He states to you that he doesn't live or work in Colorado any longer. Isn't this "Contempt of Court" he is flat out lying?

I am forwarding this letter to the County Attorney so that they can also see how my case is being handled still to this day. I am also supplying you with current information on his Address, Phone, Employer, Employer Address, and Employer Phone. To this date I have no answers from Az. DES where my money is?

Common workers no nothing of inner workings of system

Dear Kelly,
Your job with daycare is a far cry from dealing with any issue of DES or the court system in Az.
As I stated, the man working for DES I met was a good guy and this is why he told me the truth. I have clerks of the courts who talk to me about knowing files go missing and things happen. One clerk was asked to change records, and alther documents but she could not do it so she put her notice in to quit. Until she did they harrassed her in everyway they could. You need to remember, all agencies have a system within a system of its inner workings and the right hand does not know what the left is doing. A front desk Child service worker may see parents coming in who are upset, angry, out of control so this is their impression of why they lost their children but the truth may be this is the "end result, reaction, PTSS of all that has happened to them and their kids. Even in a DA's office you will see that the longer you work their the more you believe their system and that "the people" "the citizens" are not one of you. Daycare is merely an "outlet" of DES and your work, insurance and benefits are from citizens taxes and moneys. Like the Commission on Children and Families, ever ask your self what they do all day ? What is really going on ? Or whose judges wife is running the show ? If you want to learn you must come out of the box.you have to dig in and see the bigger picture and you will find an agenda that is not about "helping" but profit. It is not just DES, or child services, or the courts it is all levels and begins in politics and city and state and federal levels. The Concilliation ( Court ) ? is not a court it is a non-profit agency having nothing to do with the courts. Under open public records laws they are liable to you as a citizen to show their records on demand. The Bar is an association unaccountable to anyone and not created by the people nor representing the people. Both the bar and judicial commission are run by their own kind ( the fox guarding the hen house) and they have no record of dismissing or disbarring attorneys or judges above 2% and those are just purged out sometimes because they are defending their clients. Your judges are to be elected like your DA and yet they are mostly "appointed" but the governor..but he is directed by the bar association and these elected are closed with no opposition because the bar see's to it they are not allowed to be opposed. It goes from this level by state to federal and even your Presidential elections are really no choice to you or me. It is pre-ordained by their secret societies that run this country and are running it into the ground right before our eyes.
Ask yourself, how and why you got hired to this daycare position ? Do you have kids ? Were you on welfare, are you an Hispanic or foreigner ? Is there someone you know ? Somehow, you got this job and it was not luck. You sound very innocent and that is often what they want. No doubt some programs are for the good but they are also cover ups not unlike womens resource centers. More moms lose their children and jail their husbands going through them then on their own. And no agency should be collecting federal and local funding and funding other agencies because this is a monopoly, a "frozen enclosed system" for the people.The goal is to seperate and divide. As for DES and child support their are so many departments touching this no one knows what is happening inside or out but "someone does". It is a no brainer to keep a record when they are being paid well with benefits to do this job especially when they know where the person is and works. This has gone on for more then 25 years that I know of and it continues because the courts will do nothing about it. Kelly, I am sure you are an excellent daycare worker and I respect that, but as for looking at these issues if you want the whole truth you have to read, ask questions, seek beyond what you see in front of you and you will be amazed at all the corruption perpetrated on the citizens of this country.

Not all of DES is bad

While I don't know much about the child support collections aspect of DES, I have to say DES is not all bad. The entire agency I work for is funded by DES. We do child care trainings for preschool/daycare providers. They are absolutely FREE to the teachers and schools. DES funds them all. Through DES we are also able to go into early childhood classrooms and help out teachers who may not have experience, because for some stupid reason the only requirement to work in childcare is that you have to be 16! DES also funds the program to help early education teachers advance in their careers so children will have teachers working with them who actually know what they are doing (anyone who knows anything about child development knows that the first years of life are the most critical for development).

I also receive health insurance temporarily through DES until the health insurance at my place of employment kicks in. I am disabled and need this temporarily so I can actually work. My caseworker was on the phone with me almost daily letting me know what paperwork I needed and what was still missing from my file, and updating me on my case.

Again, I don't know anything about the support collections aspect of DES, but I wanted to let it be known that there are some good aspects to DES. I wish you all luck in getting your support. Its too bad that our society lets you first be victimized by the fathers who don't own up to their responsibilities, and then you're again victimized by the very agency that should be helping you.

Arizona Manufactoring Victims for Profit No Justice in sight

To all who have issues on this ri off report of DES. I lived in AZ from 1971-92 and watched the corruption build. I met a man working with disabled persons here who use to work for DES/Human Services and said many times their were ghost contracts of persons on payroll they never knew but someone in the agencies and courts hired them to damage families.

My sister has three grown children and DES did not ever get her child support but when she asked for them to explain they mailed her a court order to go to a parenting class she had to pay for $50 and miss a days work and gas money for more then an hour drive. On arrival she saw many young moms and by this time she raised her kids for some 12-15 years alone. If she did not appear she would have a warrant out for her arrest. She could not get them to answer as to what this had to do with them never collecting child support and they could not answer after this experience and about
$200 of lost money for the day no one from DES ever did anything to get this support money in which he owes some $150 thousand and they know where he works. I too had my fill of this and family court and when I wished to pay for an ad in the Az Newspapers under personal just to ask if anyone had these problems they denied me space saying they were not allowed to put anything in connection to the courts being corrupt. What about freedom of press and speech ? I have two moms now calling me about their kids being taken and documents changed, papers taken and more dirty things happening so AZ is getting worse and worse all the time. The bar association ( club ) also does not allow the common citizens to have their bar ID numbers anymore when asking why They just said, "because the attorneys just don't want the public to have access to their personal informtion anymore. I am going to support anyone willing to stand against all of this in Az as I think more then 30 years of watching this is more then enough.

Great, I'm not going crazy...it isn't JUST me that's going through this!!!

My ex is in Phoenix AZ. He's been there for over a year. But I'm in Texas, where our child support order originated. Since he crossed state lines, I have been PULLING TEETH trying to get child support from this man, despite the fact that he's been with the same employer for over a year. The DES in Phoenix absolutely, POSITIVELY REFUSES to take my calls!

They have been brutally rude with me, and one woman hung up on me. I called them myself after getting aggitated with my case office's response. Every week I called to find out the status of my case, a Texas was trying to get Arizona to take on the child support order and enforce garnishment. Texas said repeatedly, "We can't get a response from them. There's nothing we can do because your ex is out of our jurisdiction. If Arizona doesn't help, then we can do nothing."

I haven't had the greatest time with Texas either, so I began to think they weren't doing their jobs and just blaming it on AZ. But nope! It's true. Arizona is like a giant brick wall!! It took them 11 months to finally put the child support order on their court system. When they finally did, they didn't bother to notify ANYONE!

But since November, I've been waiting for them to enforce the garnishment order on my ex's paycheck. So far...NADA! Texas has placed numerous phone calls, emails, and faxes to their office, without a SINGLE response from a live person. And they've mailed REGISTERED letters asking for a response once a month, EVERY month for 12 solid months. Still nothing.

The two times I called and got through, they were annoyed that I did and told me that they couldn't speak to me, that they can only speak to my caseworker. I firmly said, "Well then TALK to her, because she's been trying for months, and it appears it's YOU who won't talk to ANYONE!" The customer service rep growled "Your complaint has been noted" and she abruptly hung up on me.

I still call the automated DES hotline everyday, in wild hopes that my case has been updated. They proudly state, "Your case is in the enforcement function." But that's FAR from being true! How they can say my case is being enforced when I haven't received a dime since they took on the support order, while my ex has worked every single day just down the road from them is BEYOND ME!

I don't know WHAT'S going on with the DES in Phoenix AZ, but it's PATHETIC!!! They give a resounding confirmation to the stereo-type of "Government workers are lazy".

Can anyone give me a tip on what I can do??

You should call the Des and tell them that you would like a copy of all the checks that are on the paper. They have to give you copies if you dispute what they are saying. They have one thing on their minds that is money for them... You mean nothing to them and neither does your ex. Cases that are that old are thrown to the files and not looked at. If they refuse you go to the nearest court and talk to the Jp ask him what papers are to be filed against them for contempt.

I realize that you may be afraid to do this but, it is offense and defense when it comes to matters of this nature. They must prove beyond a reasonable doubt that you received in your hand those checks.

One thing that you should know is that you have to be positive you didnt get that amount. Do your research first!!!

Also was there any amount that was owed to the state, were you on the system after the divorce. Another thing is keep a record of whatever he is paying.

If you get a check once a month then you need to write it down in the log and then call twice a week or once a month and keep a record of what they say he owes. Hope that this helps, be strong and tough when dealing with them.
