As of 9/1/03, National City Mortgage sold my loan to Aurora with all terms, rates, agreements & contracts remaining the same with NO changes. My 1st bill from Aurora was for $662.26. My current payment contract with National City was for $639.49 (this included all interest, principal, escrow & homeowners ins.).
I sent in a payment of $638.49 with a letter & copies of my contracts & all amounts broken down from National City. The following month's bill & thereafter from Aurora was still for $662.26 - THIS DID NOT INCLUDE HOMEOWNERS INS. My previous bills were for $688.97 & my present bill from Aurora is for $672.06 that includes Fire Insurance ONLY.
I sent in many letters & copies of my contracts with request for an itemized breakdown of all monies going towards each item of the loan. I received nothing from Aurora except more bills & letters of different amounts & a monthly bill for $4586.92 that has been cleared via Chapter 13, along with inquiries that I am not covered for Homeowners & that have picked up fire ins. for my home with additional costs of $880.00/annually.
I called many times & the one person I actually got to speak with informed me that they have never received any letters of copies of National City's Contracts & that I must pay what they require of me. It is impossible that they did not receive any of my letters, let alone 1 of them, considering they were sent with my payments, each time, & the payments were received.
On 3/14/05, I received a copy of a Request for Dismissal of Chapter 13 Protection (my Bankruptcy Case), from Aurora Loan Services, in an attempt to foreclose my home. I have made my payments to Aurora, in full, each month, since the transfer. I have received absolutely no customer service nor Account information, as requested, from Aurora Loan Services. They attempt, each month, to collect my pardoned debt of Chapter 13. They have not cooperated with me in any way, shape or form & are now trying to foreclose my Home.
I will appreciate any help & advise you could provide me with.

You need a lawyer, ASAP! Someone well-versed in predatory lending, RESPA and TILA violations, etc. Aurora is trying the same trick with us--only it involves getting our lawsuit dismissed because they claim they were not included in our Chapter 7 BK.
Please understand that you need to recheck your Chapter 13 and note exactly what it says about your loan. In a Chap. 13, one usually keeps paying on the mortgage and your personal liability for the debt may remain intact. In a Chapter 7, the usual scenario is that personal liability for the balance no longer applies. Please check on your bankruptcy case ASAP.
In any case, what they are doing otherwise is exactly what they are trying to pull on us. Please get legal assistance. You don't want to deal with them by yourself. I hope you have everything in writing, but it sounds like Aurora even refuses to co-operate in that area.
Also, I believe that by law a lender MUST provide you with a breakdown of the accounts held in escrow. Sure sounds like they are hiding something.
The poster who indicated your raise in premium may be correct, but my guess is Aurora is pulling its usual tricks.
Though I'm not 100% positive, I believe it is against the new Predatory Lending laws to force place insurance on a property by a lender if an insurance policy is already in place. But that is the least of the problem.
Aurora consistently refused to supply pay off figures for a short sale of our property even though our realtor had 3 buyers with extremely good bids. One even had already bought title insurance and set up a closing date. Aurora dragged its heels so long the buyer finally gave up.
Aurora has a bunch of excuses why they can't provide info or explain their actions. They are just biding their time. In my opinion, Aurora is out to collect foreclosures. What they did in our case, especially given the fact they were only the 2nd mortgage holder and had less then 1/3 interest in the house, is enough for me to question their motives. They got the house alright. Even the 1st mortgage holder was unaware of what they did until months after the sheriff's sale.
Some predatory lenders will immediately begin foreclosure actions if a customer sends in less then the amount the lender has requested, EVEN IF the borrower turns out to be correct. Please be aware of this. You need to get this settled quickly.
I believe this company is well on its way to the top of the predatory lender/servicer list. Beware and watch every little move they make. Check your statements with a fine tooth comb.
Please keep us posted on what happens. It is very important; your home may be at stake.

I am a mortgage lender and but I do not work for Aurora Loan Service. I think I may be able to offer some insight as to why there was a change in your payment. I can only speculate, but the difference between payments when a loan is transferred can sometimes come from your taxes or insurance premiums.
More than likely, when your loan was transferred to Aurora they verified your escrow account balances. If they find that there is or will be a shortage they will adjust your monthly escrow amount to correct it.
This ensures the company that they will have enough funds to pay your property taxes and your hazard insurance. If they over collect, at the end of the year they have to refund that money to you. Double check the property tax info and your hazard insurance premiums to make sure that Aurora has the correct info.
I think it's a disgrace how they have treated you. It could have saved you a tremendous amount of grief and them a lot of money to simply answer your questions. Your are also correct to go back to your original note that you signed at closing. They can NOT change the terms of your loan.
The only reason they can lgally change your payment, unless otherwise provided in your note, is to adjust your escrow account. I apologize on behalf of the honest people in the mortgage industry.You should also consider going to the loan officer you originally got your loan from. They should be more than willing to help you resolve this problem.
