Surplus escrow refund check in excess of $100.00 was attached to disclosure statement. I accidentally filed disclosure statement with check attached. When I discovered the check, I was unable to cash it because it was void. Returned check to Aurora with balance required to make monthly mortgage payment.
For more than a year Aurora has refused to apply the escrow refund amount as per my request stating the surplus escrow was returned to escrow 6 months later in violation of RESPA; have added monthly late fees alleging my account to be in arrears. RESPA requires that any surplus in excess of $50 be refunded to borrower. Aurora returned the surplus refund to escrow within the same review period.
If there are others with misapplication of surplus escrow refunds or escrow over charges who is interested in class action, please submit complaint to Ripoff.

Possibly a misunderstanding of what happens with void escrow refund checks

If an escrow check becomes null and void after it has not been cashed for 180 days it will then we placed back into your escrow account and if you "find your original check" and try to get a new check, they must first determine if at that time there is a surplus. If your taxes or insurance have increased since the last analysis, giving you the same refund will cause a larger shortage therefore causing you payment to raise when the next analysis is ran. I bet if you call and ask where that original refund is they will be able to provide proof that it is back in your escrow account!
