Bank of America does not pay items as presented. They "pick and choose" the payment of item in order to incur the largest amount of overdraft fees. They turn a deaf ear when you protest this practice. Bank of America shouldn't be entitled to any stimulus money. They already have their own bailout...it called overdraft fees! "We the People" need to take back our power and stop being victims. Inundate the White House with letters and emails demanding that the president do something about B of A. What they do to the American people is true terrorism!

To read that quote from 7/16/2007, simply 'Google' this- RIP OFF REPORT TOYOTA MOTOR CORPORATION USA MANIPULATION, and go to the 'Update' to Charlene's Ripoff Report which is titled- 'SUGGESTION'.

FACT: The Dow Jones was around 13,800 on 7/16/2007, and the Dow reached 14,000 for the first time in history just three days later. On 7/19/2007, the Dow reached 14,000 for the first time.

FACT: Just 3 weeks after that quote, the Dow Jones had its first 'hic-up', and LOST 387 points on 8/9/2007.

FACT: The Dow Jones has LOST over 6,000 points since then!

FACT: American's 401K's have DECLINED significantly since then.

To read that quote from 9-3-2007, simply 'Google' this- RIP OFF REPORT GM CREDIT CARD SERVICES, and it appears in the first 'Update' to Betty's Ripoff Report about how her 'credit card interest rate' went from 10.99% to 32.44%.

One month later the Dow Jones closed at its all-time high of 14,164. On 10-9-2007, the Dow closed at 14,164.

Too bad NO ONE listened, huh?

To read that quote & others from the Professor, 'Google' this- RIP OFF REPORT FUEL FREEDOM INTERNATIONAL MPG CAPS, and go to the 2001 Toyota Tacoma Report, and then to the 'Update' entitled- 'Blame it on a Lawyer'.

That 'Update' was posted on 8-21-2007 when the Dow Jones was around 14,000. The Dow closed at its all-time high on 10-9-2007, which was 14,164. The Dow reached 14,000 for the first time in history on 7-19-2007.

I agree with one part...

I agree that you should stop being a "victim".

When you stop being a victim, that will allow you to become a person who manages their finances responsibly. When you do that, you won't have to worry about overdraft fees.

I can tell that you spent more money than you had and you were charged for each transaction that resulted in a negative balance. The key is to not exceed your available balance. It really can work... I currently have $1.73 on my BofA account and I haven't yet had to pay an overdraft fee.

You describe the bank as engaging in 'terrorism' which they are not (at least from your posting). "Terrorism" is an emotionally loaded word that does not fit here. This detracts from the merit of your complaint

Once again....

Bank of America or ANY bank does not "pick and choose" the way they pay items presented. They do it the exact same way each and every time. They post items HIGHEST to LOWEST for every item that is received since the last cut-off time for posting. However, the only time you notice this is when you spend more than you have available in your account.

While your report was lacking in details. Once again it probably has to do with your Debit Card usage for very small items. That in combination with you relying on on-line banking and not your own register then spending more than you had available created a lot of OD fees. So the best thing you can do if you don't keep a very accurate register and make sure you don't spend more than you have. Is to cut up your debit card and go back to using cash. You may still OD, but at least you will only be hit with the fee when you take out the cash, rather than for that $5 cup of coffee..or my personal favorite(from another person's report) that $0.42 stamp.

Oh, you really think the President or Congress will do anything about this. This has gone through Congress and the Courts several times. The courts have ruled the fees and posting order legal. Yes there were suits that has to do with disclosure but those were settled years ago. Almost yearly, Congress puts up bills for PR value but have never acted on them. By the way you know the VP is from Delaware which has the most lienient laws in regards to banking and credit cards. Which is why a majority of these companies are located there.

And yes I am very sure I will be once again accused of working for BofA, but I have never worked for BofA or any bank. I am just one who chooses to abide by the terms of the bank I use. As a result I don't spend more than I have(and yes have had very low balances), in exchange for this the bank does not get it's ovedraft fees.
