I am an attorney practicing in the Mid-Atlantic region and recently had the misfortune of having to deal with a Mr. Will Allen over monies that they, as an assignee of third party debt, claimed was due and owing from my client.

 

  Rather than keep the matter on a purely professional basis, Baxter Bailey, through Mr. Allen's thug-like actions,  apparently condones not only contacting innocent third party customers, who have nothing to do whatsoever with the underlying claim, but also apparently looks the other way while disseminating personal information relative to my firm and my family. These guerilla tactics are, apparently, par for the course for this wretched and morally corrupt business.

An Open Letter to the Membership

I am writing this letter for two important reasons.  First, to clarify some information appearing on our website and the Council’s December issue of the TransDigest.  Second, to provide some advice in dealing with the “double payment” problem.

There was an article on our website and in the Council's December issue of the TransDigest about a “notice” being disseminated by Baxter Bailey & Associates, a collection agency widely criticized for its collection practices.  The notice was essentially a solicitation for business from carriers for collection of unpaid freight charges, and listed a number of "placements" - essentially brokers and others that allegedly had not been paying their carriers.  We immediately received responses from some of our members.

One was from a member, XPO Logistics, that was listed on the Baxter Bailey notice.  The member said that the name of its company had been improperly listed and sent us a copy of a retraction notice from Baxter Bailey that supposedly had been sent out to "All Carriers" stating "Please note that    XPO LOGISTICS  MC 175952  HAS BEEN REMOVED FROM THE BROKERS ALERT LIST AND WAS LISTED IN ERROR.  Obviously, XPO was genuinely concerned that the false information could damage its relationships with its customers and motor carriers.

Another was from a member who said:

We've been members for 15 years. Why would the T&LC even mention anything that Baxter Bailey says?  This organization is VERY unscrupulous in their dealings with the shipping public. I'm sure that many members have received harassing, threatening calls, letters and emails from this organization and their owner J.T. Reesor.  Surely there has to be a better source for this kind of information. Citing this company like it's a "creditable source" (on anything) in the transportation industry, is disappointing.

The purported "President" of Baxter Bailey emailed me on 7/14/15 and attempted to strong arm me by threatening to post personal information about me. The funny thing is, he did not even use my actual name. In any event, this is indicative of these guys conduct themselves. Buyer beware!
