Beneficial Mtg. offered me a mortgage with a lower interest rate to reduce my monthly payments. I was behind on a pool loan with them, although I was making monthly payments. I had become disabled and suffered reduced income.

It turned out to be a much high interest rate, which I told Guy Joners, the manager who contacted me, that I couldn't afford. He threatened me and told me I had to sign the papers. I was very scared and signed some papers that were back dated and forward dated. None were dated on the date I signed any papers.

I couldn't make the payments and they began foreclosure action. I hired an attorney, depositions were taken, the judge ruled in Beneficial's favor and I lost. During my Deposition, documents were shown to me with my signature on them that I had never seen before. I was bewildered as to how Beneficial got my signature on all those documents, and still do not know.

I fired my attorney, represented myself (pro se), filed an Appeal, and won my appeal. In the interim, Beneficial went ahead with the foreclosure and my home was sold at Sheriff's sale. Beneficial sold it about 7 months later. Beneficial filed in Supreme Court; however, I won.

By then, I had another attorney. The case was remanded to Common Pleas court for trial. Beneficial fought going to trial all the way. They had the trial postponed by asking for a Continuance. Another trial was set for early August 2004. Just a few days prior to the trial date, Beneficial went to the Clerk of Court's office and dismissed the case. My attorney filed a Motion To Strike in August 2004 to overturn the dismissal action. Judge Reece has not yet ruled.

This ordeal has tied up 6 years of my life, left me with nothing, and leaving me feeling violated, taken advantage of, stolen from, lied to, and a victim of 'lender rape'.

I am a senior citizen, disabled, and have no idea how I can ever own another home. I live in a small bedroom with one of my daughters, and all my belongings are in storage. This is not how I want to spend my senior years and I didn't think I would ever be in this situation.

Beneficial Mortgage took full advantage of my situation, and had absolutely no regard for me at all. I regret that I so weak that they were able to do this to me.

I feel that Benefical got away with fraud, forgery, and theft by deception. I want more than anything to see this company have to pay for what they have done to me, as well as to many other people. My case was not included in any class action suit or settlement, and stands alone. Beneficial needs to be put out of business.

Beneficial signature forgeries

You verified exactly what I have been saying about Beneficial Mortgage forging signatures.

I have screamed to the heavens about Beneficial forging my signature on numerous documents. I had a 'handwriting expert' review documents. At the meeting, numerous documents that had been at the Deposition were not available at the handwriting meeting. Numerous other documents were presented that I had never seen before.

My attorney, ex-attorney now, did nothing about it and seemed very happy with himself over the situation. Naturally, nothing came of the meeting except that the 'expert' said the signatures apeared to be mine. She did send copies to me several months later and remarked that she had been provided with 3 different copies of a mortgage. She instructed me to view them very closely because they had different markings. I found those markings, noticed that the three copies would not line up when held up to the light, signatures were off by quite a bit, and the worst part is that I DID NOT sign any mortgage with Beneficial. The first time I saw the mortgage was when I received the foreclosure notice from the Court.

How do they forge signatures on documents? This was just one document of many that they forged my signature onto.

I live with this nightmare daily because I fear they have forged my signature on other documents that I have never seen. It is something that I will carry with me the rest of my life.

I found so much fraud, including two separate appraisals done the very same day, the second one increasing the value of my home by sevweral thousand dollars from the first appraisals done a few hours earlier. These appraisals were done by the same appraisor.

I cannot understand how the courts can turn their heads away from the unscrupulous activity going on with Beneficial. The Appeals Court said my case was one of the WORST cases of Predatory Lending they had seen. They remanded my case back to the Common Pleas Court. I am sure they did not remand it back so Beneficial could go to the Clerk of Court's office and dismiss the case.

The problem is in the Common Pleas Court. The previous Judge, Lisa Sadler, ruled in their favor, even though she had been made aware of the differing mortgages and all the other questionable activity taken place in my case. Now I am awaiting Judge Reece's decision as to whether he will allow these thieves to get off scot free. I pray that God gives him wisdom and guidance in my case and that he can understand the full impact of what this company has done.

Unfortunately, I am not the only victim. They have victimized so many people just here in Ohio, especially in the Dayton area. I was fortunate enough to meet some of these other victims when I was asked to speak before Legislature in Dayton two years ago regarding predatory lending. My heart aches for all those other victims.

My case needs to go to trial. Beneficial Mortgage needs full exposure nationwide as to the horrible activity they are carrying on with the public and the severe victimization of citizens. They should be put out of business!

BENEFICIAL MORTGAGE HAS TURNED THE SCALES OF JUSTICE AND TAKEN THE LAW INTO THEIR OWN HANDS. NO COURT SHOULD TOLERATE THIS KIND OF ACTION BY ANYONE!!!! BENEFICIAL NEEDS TO BE PUT OUT OF BUSINESS.
