Brewer Caldwell Property Management Beyond Reason Gilbert, Azgilbert Arizona

I am encountering a situation with a property management firm of which I need to know who can help me get it resolved.

We had a home built in Tolleson which was completed in 2007. After one year, we decided to rent it out and hired Brewer Caldwell to

1. find qualified tenants to rent it out ($300
deposit/additional $600 when tenant placed)

2. maintain the property for us ( 10% of monthly
rent)

After one year of visiting back and forth between our LA home and the new home with absolutely no problems of any kind, two months after we signed with Brewer Caldwell, our house was burglarized by someone who had the key to the front door and also the keycode for alarm ( provided by witnesses and documented in police report). Everything in the house was stolen.

The police detective and the insurance private investigation firm had confirmed that the evidence in fact looked really bad for the management company or someone with access to the firms information, i.e. vendors, real estate agents, who Brewer Caldwell utilized. We lost up to $50K and the insurance hasn't paid a cent as it is under investigation ( that might end up being another subject later).

We had paid the $300 depsit and $600 placement fee for them finding a tenant ( which has been placed) but we didn't want to continue with the maintenance portion of the contract as we had lost complete trust in Brewer Caldwell and also didn't want them to handle any fiduciary matters concerning us. I wrote them and simply asked them to drop the maintenance portion of the contract since they hadn't entered into that portion of the contract time period yet ( the first maintenance month of the contract year). They would be out no money nor effort as they hadn't started yet...they stated they could cancel but if they did we would still have to pay the 10% fee per month for the whole year.

I have appealed to their goodwill and professional consideration due to the extenuating circumstances of the burglary....it fell on deaf ears.....
