I am a tenant of BC 2x over. My husband and I thought we would be ok the second time around because we believed we could trust our salesperson. Boy were we wrong! In the first 3 weeks we wanted out! THere were so many health & safety issues. Maintenance issues, illegal procedures related to our move in.

The sales person even showed up the night we moved in and demanded we sign a different leAse for more money! THe option was sign or get out! We had no where to go so of course we were backed into a corner. But of course our concerns and gripes fell on deaf ears. We tried everything! Even The BBB. Then there were issues because what we were promised would be in the house was not there, the yard wasnt done the way we were promised. But oh, it could be if we wanted to pay more!

Finally we just decided to hang in til the end of the lease. So as that comes closer we get ready to find somewhere new w/o BC. We finally have things in place and were very upfront w/BC from as early as 60-90 prior to the end of the lease to tell them we were through!

Then we get a nasty letter from the owner bashing us b/c of things BC has told her that were unfounded and untrue. I let it go and decided not to remark but simply get out At the end of the lease and move on.
We advised BC when we advised that we were leaving that our last months rent would be late b/c of our moving costs but that it would be paid.

We moved big items out w/a moving truck and left small sentimental things that could be moved w/our own truck or cars. We started moving out 1 month before the end of the lease to allow us enough time to move out, clean the house etc. 2 weeks before the end of our lease BC changed the locks and stole our stuff!

THen claim we abdandoned the property yet never sent us notice (as outlined in the landlord tennant act) or tried to even contact us. They claimed they had no good #'s for us. I went in to the office and demanded to see our file in which my work # was listed, my husbands, my parents and my in-laws phone #s!! Are you kidding me? They said maintenance had our stuff then maintenance said they didnt have our stuff.

Oh my goodness! So of course we contacted the police. We are still dealing with this and still have not gotten our things. Neighbors identified maintenance as removing the items from the house and yet BC claims no responsibility or knowledge. Funny tho, the head of maintenance and the maintenance man who took the stuff are now no longer with the company. Since then I received a bill for items removed. Even with everything we still cleaned the house top to bottom, left nothing. So what did they have? I demanded a list of everything. Its now nearly 4months later and nothing even after several requests!

We are pursuing civil action. I have already talked to Chris @ BC and much like everthing else and everyone else there, worthless. Let me know of your dealings please, and if you havent used BC before, steer clear and avoid alot of heartache.

The BS about the "abandonment notice" is part of legality issue. Seeing as how BC did not follow the legal guidelines in sending this supposed notice. It is required to be sent certified mail according to the Landlord/Tennant Act in AZ. And if I recall correctly I have an email from Teri herself confirming that was not done. As for being cooperative with the police and myself that is also a fabrication. Unless taking 3months to produce requested information is considered cooperation...

More lies

Amazing how Brewer Caldwell cannot get their facts straight or manipulates factors to cover their wrong doings. To say there is no 30day notice on file is an outright lie. The fact is I have an email confirmation from 2 managers @ BC that confirms it was received. It was also mailed certified mail which I also have a copy of. Nice try tho. As for the letter from the owner, it came 6months prior to our move out so it could not have been due to move out photos. ALSO..the move out inspection was not completed until after we had come into clean up the disaster the maintenance person left after he ransacked our house and stole our property. Amazing. Thats ok, all these facts will be coming out in court. Good thing I kept ALL the email transmissions and mail confirmations to back up the truth, something BC seems to not have a good handle on.

Brewer Caldwell Rebuttal

AUTHOR: Teri - (U.S.A.)

POSTED: Thursday, June 14, 2007

From the stand point of Brewer Caldwell property Management, these are the events that transpired.

It is very difficult to respond to allegations that are not specific. What maintenance issues? What illegal Procedures?

The reason the tenants received a letter from the owner was simply because she was sent by us the move-out pictures. Nothing needed to be said it was all self explanatory from the pictures.

We have no 30-day notice in writing from the tenant; our policy is in writing on the first of the month 30 days prior to the lease expiring.

The tenants did not pay there last months rent, we sent them a 5-day notice, and we received no response from them. We then posted abandonment on the door, waited the appropriate time before entering. 30-31 days later the tenant came in to pay the rent.

At this time is when BC found out that there was some items left that the tenant still wanted. We confronted an employee in the maintenance dept who told us for over a week that nothing but trash was left behind and it was all disposed of. After a week the employee decided to then tell us there was a computer that he kept. This employee was immediately terminated and we have been very cooperative with her and the police in this matter.

Thank you,

Brewer Caldwell Employee
