I have had 9 different numbers calling from Capital One and their collection agencies. I have told the callers, emailed several departments, emailed the CEO and even got on their facebook to tell them they have the wrong number and they won't stop calling and harassing me.

STOP CAPITAL ONE CALLS

AUTHOR: KLOUISE - (United States of America)

POSTED: Friday, July 20, 2012

First of all, what you should have said to the person calling you for the wrong person is "you have the wrong number therefore please remove my number from your list".

It always works for me.

Or, you can do like I did and start yelling at them like a crazy person every time they call.  That'll make 'em stop.

Hi, Josey.  How the h*** are ya?!?

File a suit against them with the BBB and the FTC. I had a similiar thing happen with another CC company.

Credit card companies will act like animals and lie to boot.

Instead of attacking Mocha, who was giving the OP decent advice, how about offering the OP your own solution to their issue?

To the OP, I believe the law allows you to go after collectors who don't stop harassing you. You might have to spend a few bucks mailing them a certified letter to cease and desist calling your number, but it could prove lucrative if they don't stop, because you can then sue them, as Mocha wrote, for punitive damages. Look up the Fed or state laws regarding this. There ought to be info on the web.

So the person whom they are looking for is not living in your house, correct? Then tell them that they should pursue a law suit against the person they try to call to and stop calling the number again. If they don't, tell them that you will sue them because you are not the person whom they are trying to contact.
