I wish I would have done my research on this company before I ever used them. I took a loan out from them a few different times and paid them back each time. Well apparently this last one went into default and hasn't been paid. I received a call from someone named Alex today with a company who claimed to be a law firm; which I won't put their name here but I do have it, (and not only did they call me, they called my apartment manager and my parents trying to get a hold of me after they left me a message to call back) and my account had been turned over to them by CashNet USA and all of a sudden my costs are up to $1,751.55!!
I called back and ended up speaking with someone named Stan who seemed nice enough but made it sound like I was going to be prosecuted on this stating an affidavit (sp) has been filed for malicious intent and theft of goods for services from CashNet USA. He asks me if I can get this paid and how I'd like to take care of it. So I am completely freaking out, say the best I can do is $250 per paycheck (which is a lot of money but thinking I need to figure out how to pay this and all my other bills because I certainly can't go to jail on this) and he says let me speak to someone. He comes back and says that is fine, I'll transfer you to the banking department to set up direct payments from your checking. I say ok and I get transferred to the next guy who is about as rude as anyone can be but the arrangements are set up and done.
I set up the arrangements thinking to myself ok, well what can I do, I have to get a part time job or something because let's be honest, if I could have afforded to pay it back...I would have done so already. I mean $250 is alot of money out of each paycheck which is now coming out of my next 7 paychecks!! I'm completley stressing out wondering how I am going to come up with this money to pay this account and all my other bills.
After I spoke to them I went to the CashNet USA website and found this for my state: "CashNetUSA is licensed by the Department of Corporations pursuant to the California Deferred Deposit Transaction Law.
Customer cannot be prosecuted or threatened with prosecution to collect on a deferred deposit loan." If that is the case, then why was an affidavit (sp) filed and all these legal terms thrown at me. I seriously feel like I was just threatened with this.
Seriously, I have NO idea how they can rack up charges 490%!! Something here stinks and I do not believe this is on the up and up! If anyone has any information and/or can give some advice, please let me know because again, this basic $300 loan went up to $1,751.55 and I don't have that kind of money.

Hey stop paying this immediately if you contacted cashnetusa directly they would have told you it was a scam.. after your debt has been deemed unretrievable they write it off and your information can be sold to third party collectors who then have all of the information you provided to cashnet. I guarantee you that if you stop paying this no further action will take place they'll tell you they're going to go ahead and proceed with charges that will never show up..

Hi, I work for a collection agency (don't worry it's not one associated with CashNet). Anyhow, I understand that they used 'legal' terms at you which isn't technically breaking the law. What I'm interested to know what exactly was said. You are right, they cannot threaten you at all, or it's a violation of the FDCPA. If they did threaten you, their phone calls are recorded. Technically, if CashNet doesn't use an outside collection agency they are considerd a 'first party collector' and they don't have to follow all of the FDCPA rules when collecting. They still CANNOT THREATEN YOU!
For example if they said, "This is going to cause you to go to jail and we'll get an affidaviate of intent to defraud because you're not paying what you agreed to pay on the date you agreed." this is considered a threat.
Let me know what happened. Just remember, they CANNOT threaten you. If you feel threatened call and ask for a manager or tell them you'll file complaints with the Attorney General and Better Business Bureau. Then make sure to follow through!

Dawn, don't sweat this at all, but if I were you, I know this is a few months old, but I would like to know how you handled it? I hope you closed that bank account and opened a new one. I have one with Cashnet and I keep getting e-mails but that is it. Cash net does not use outside collection agencies, I actually asked them if they do and they said they have their own. Don't fall for any legal crap people throw at you it is just to scare you. Good Luck and if you would let me know how this was handled with Cashnet.

I left this supposed "law firms" name off my last post but now that I see others have reported them, I am adding their name. I see they are not a law firm at all but just a collection agency. I will be changing my bank account number ASAP so that no payments get sent to them. They put absolute fear in me that I could be taken to jail if I didn't pay this! I will be contacting this agency in writing to send me the information they have and tell them I will only deal with CashNet USA and will settle this with them. I am then going to contact CashNet USA to settle this.
Does anyone know what happens if CashNet USA tells me they won't take the payment for the original debt? I had that happen recently with a different collection agency. I kept trying to work out an agreement and they wouldn't take it and instead passed it off to another collection agency which was supposed to go out yesterday. If I can nip this other agency in the bud with any rules and regulations they need to follow I'd love to get it handled before it gets as out of control as this one did.
