My husband and I have used Century 21 Mortgage for 3 years now. The very first issue we had with them was before the closing on our home. We were required to get homeowners insurance to complete the closing. Century 21 Mortgage told us that they offered homeowners insurance and we opted to purchase through them. Weeks went by before we were told that we still did not have any coverage on our home to be. It was a week before our closing, so we called C21M to find out what was going on. It was then that they finally decided to tell us that they did not offer homeowners insurance in the state of Florida. That left us a week to find an insurance company and come up with roughly $700 for our premium. Talk about ticked off! That was just the beginning of our problems with this company. (Don't get me wrong. The real estate agent was wonderful. I never had any issues with Century 21 Realestate. Our agent told us that they would never recommend or use Century 21 Mortgage again. That's pretty bad when your own company won't even recommend you.)

Our most recent issue with this company was bad enough to report here. A few weeks ago, I mailed a paper check to C21M for our usual payment. About a week later, I called the bank and found out that they had taken out $360 more than the check was written for. My bank couldn't do anything about it, so my husband called the mortgage company. He was told that it would take 3-4 business days for them to contact us and tell us whether or not it was the mortgage company's mistake. After 5 days of no responses, I called them. They apologized and stated that they would refund the money plus any bank fees that my bank charged me. All they needed were my bank statements as proof of the transactions. I obtained the statements and faxed them to C21M along with a letter. (The total fees that they owe are $600, by the way.)

They called me today and left a message stating that they were sending a detailed letter along with my cancelled check. Well, my husband called them back to find out what was going on. They told him that they were not refunding us and they were not going to send a copy of the check that they supposedly have, after stating otherwise. So, I had to take off of work to dispute this through my bank. I strongly reccommend that anybody who is looking for a mortgage loan DO NOT go with Century 21 Mortgage.

I encountered an issue of an unauthorized withdrawal from my account by Century 21 Mortgage, but it was not during a scheduled payment since, thankfully, I never closed a loan through Century 21 Mortgage. Mine was an unauthorized cancellation fee. I never had the intention of closing the loan; the loan never closed because of poor operations within the company.

Just when the loan was a week away from closing, I had to change jobs. My loan officer with Century 21 mortgage talked to underwriting, and came back with an answer that my loan could still close after they verified 30 days worth of income at my new place of employment. The closing date was extended to reflect this, and the seller of the home approved the extension; however, when the new date was approaching, it was announced by my loan officer that the loan could not close on that date. The reason had nothing to do with me. It was just that the underwriters weren't working on getting the confirmations they required to close my loan.

When my real estate agent (who also began to detest Century 21 mortgage after this) sent the forms to request another extension from the seller, they came back saying that they would approve the extension if i would pay a per diem fee for each day after the last approved closing date. When the new date set by Century 21 mortgage was apparently not going to happen either, we had to request another extension (yes it was very aggravating), but that extension was rejected. The seller became equally impatient, so they denied extension and kept the escrow deposit.

Even though the deal falling through was all at fault of Century 21 mortgage, they still charged my credit card the cancellation fee of $350. I called my loan officer, and she said they weren't supposed to charge anything and she would "take care of it." After waiting over a month to get the charge back, I finally called my bank's customer service department to dispute the charge. My bank removed the charge immediately, and they started their investigation. Rather than just accept that they were wrong to charge my account, they produced all the documents for my loan, including those that stated my card would be charged if I canceled the loan. (It also stated that I would not be charged if anything happened that was not my fault) They also produced a copy of a letter that they never sent to me, which would classify it as false evidence. I can't believe that they put me through all that. If I had just chosen a different mortgage company in the first place, it wouldn't have taken a whole year to finally buy and move into a house.

Something doesn't add up here...

You said that you mailed a PAPER CHECK.

Now, there are companies that will 'electonically draft' the amount of the check, meaning they enter a draft for the original amount directly to your bank. When this happens, the paper check never processes. This is why you won't get a copy back, because there is no copy to send you. I can view my checks online, except the ones that are processed this way, so I would assume you can't see your check either.

IF this isn't the case, then there is a clear case of fraud, and you don't have to get the check back from Century 21, you can get it from your bank. If it was processed normally, then it is your bank's fault not the mortgage company.

My suggestion is threatening them with legal action and criminal charges if they do not refund your money.
