Chase has mishandled my mortgage and escrow account on numerous occasions, and failing to credit my escrow with the funds they received when they bought my mortgage, incorrectly reporting to credit bureaus, and on two occasions paying my homeowners insurance twice and then demanding the deposit of additional escrow funds to cover the shortage. On the first double payment occasion they raised my payment to make up for an "escrow shortage" and then refunded the overpayment 15 months later. The second time they paid the homeowners insurance twice I contacted them the moment my statement arrived. They said the mistake could be "easily" corrected by my sending them $676.68 and then trying to get the duplicate payment back from my insurance company! Not wanting another payment increase incident, I sent them a check for the amount specified, to the address that they indicated. The check and the envelope were clearly marked in large letters "For Escrow reimbursement ONLY". I also included a note explaining the reason for the check, and also a payment coupon which was not only marked "for escrow replacement only" in large letters, but filled out to indicate that the entire check was an escrow deposit (the other lines were even marked out in bold black ink). Chase cashed the check on Dec 31, for $1000 more than the amount I'd written the check for. I have a duplicate (carbon copy) of the original check which shows the amount in words. I was not notified by my bank (TCF) until January 4, that the check had been cashed for $1676 rather than $676. When I contacted my bank I was told that Chase requested the amount electronically and did not present a scan of the check for verification. When I contacted Chase I was initially told that I had miswritten the check amount. When I explained that I knew that wasn't true because of the check copy, I was told that the additional funds were credited to my account as an additional principle payment! When I expressed the fact that I didn't WANT to make an additional principle payment, and had only written the check to correct Chases previous error, I was told that, in fact, they had not even credited the full $676 to my escrow! My mortgage payments are current; in fact, since I have automatic withdrawals on a bi-monthly mortgage, my payments are actually ahead! Chase has repeated denied responsibility for any errors and has refused to refund the $1000 that they stole from me. This of course, has caused problems with my bank account since the money they took without authorization was intended for other uses, like eating and heat.

You have a legal right to accurate accounting of your mortgage. There may be fraud in your mortgage that you were not aware of. You can take that fraud and make those that broke the law pay rather than you paying them to defraud you. When the banks break the law they owe you money, it says so in the law. The way to show they broke the law is in auditing the paperwork. A forensic audit performed by certified professionals can go over mortgage documents and find the violations of the law. Since a crime may have been committed you need to treat the paperwork as such. From an audit then a letter asking for more information or a rescission letter asking for the return of all money paid in. From there litigation paperwork can be created ready to file into court. They do not want their violations of the law before a jury of 12 homeowners who may wonder if they were defrauded as well.
