 I would like to start saying that when I signed the contract the day CNAC approved the vehicle they had a form in which they are saying that I had to have the payments charged to a credit card in order to be acceptable. THey also recorded while explaining the "contract". I would say the first year payment were ok until I lost my part time and my payments were running 7 days late. In my house we have two vehicles under CNAC one recorded with my husbands credit card and the second one under my credit card. My husbands card was charged on a different week than mines.  The first time I had my card charged was for a payment under my husband,

I was at the grocery store getting food when i swipe the card said declined, I was how is that possible? ok, so I go online to my account to see any charges and effectively CNAC charged my card without my authorization. The second time they did it was for my husbands car again so I called and spoke to one of the people in charge (male). He told me oh the card was charged by mistake and kept going with the lies. How are you supposed to charge my card when is under a diff contract number and I NEVER authorized it? arent you supposed to call me first?

He said oh it was a mistake all you have to do is go through your bank and we will give a credit, when I report teh charge through my bank they investigated and CNAC told my Financial Institution that I had used that same card to make payments before and never gave my money back. The Second time and employee (female) charged my card again and when I called and ask why they did it again?? there answer "oh that was  Ms. "white" and today was her last day working here... really? I cancelled my card because they would continue to do it,

and so today MAY 6, 2014 one of the managers called me asking for payments and that what was my CC number I said NO Sr. I do NOT authorize you to have my number on record he was very upset. I requested a ledger to see my payments and stillthey have not send it to me, I have paid the car for more than 2 years and they say that I still have a balance that when I divide I noticed that I am paying too much for what they made me sign.....I NEED HELP to stop this ASAP I am willing to go to court or whatever is needed to have justice.

Let's start with this...you are with this SUBPRIME lender because you have bad credit.  Here we are today and STILL you're not making payments on time.  There are TWO of you in that household, right?  Two adults.  Why not get part time jobs?  What you're saying here is you are regularly late.  As such, you are generating more interest and late fees.  No, I don't work for them.

I was able to follow your line of thinking right up to the end when you stated:  I have paid the car for more than 2 years and they say that I still have a balance that when I divide I noticed that I am paying too much for what they made me sign....

What are you dividing? When you get an installment loan you have an amortization schedule for payoff. The schedule tells you the remaining balance after each payment. Compare the amortization schedule you received when you purchased the vehicle with the vehicle note and your actual payments to find out what your balance is now.

If you don't have a current amortization schedule for your loan, you can 1) get a copy from the lender or 2) go to Bankrate(dot)com and put in your terms of the original loan and calculate one. Then print it for your records.

As to the rest of your story - check your loan docs to see if the lender put in a provision that you are responsible for both your payment and jointly responsible for your husbands payment on his vehicle. Sounds like that what they did based on your post.

To solve your issue:  refinance your vehicle with another lender. That way they can't continue to charge on a card for your payment. Consider having your husband refinancing his too so you get away from them entirely. Go to a local credit union in your area. Their interest is usually much, much lower plus it is a better way to keep control over your finances. Good luck.
