My husband decided to buy a mobile home in 2000, we had a pre-nupital agreement and I did not want to be involved.

He bought the home and rented it out, then we lost the renters and my husband's job slowed down so we had to file Chapter 13, and decided to keep my house since I only owe 3 more years on it. The lawyer and trustee said to voluntarily return the mobile home to Greentree, so we did, and they started foreclosure preceedings on the home. Well, was I suprised when we got the papers and it had my name on the Deed of Trust, but not on the title or the property, and my name had been forged.
This has been a nightmare because Greentree got the bankruptcy notice but got a stay, and started calling us. The sale was in September 21, 2005.

NC has a law that the bid stays open ten days, we thought that after the 10 days it would be over, but no they send my husband a certified letter telling him they are having a private sale, but he can still pay off what he owes and keep the home.

Our lawyer said they should not have contacted us but contacted the trustee. He said that it looked like my name was forged when the Deed of Trust got to the court house. How can they do this and get away with it. My name was in the paper on the foreclosure and I wasn't a bit happy, because we are having a hard time financially still and still may have to pay a defeciency. What do they do about forgery, or can banks do this and get away with it?

Your attorney should have directed you to your District Attorney's office. Forgery is a crime and should be treated as such.
