We have tried to work with this company to modify our car payment. Our financial situation has changed, and we are losing our home. This company continues to harrass us, our family and friends, and are not willing to assist in any way. I was originally told I could return the vehicle to be auctioned off, but then was told by Mr. Smith that he was determined to collect his money and did not want the vehicle back (which has been parked at an agreed location between us and CPS for almost a month and he refuses to pick it up). He told me that it was people like us that got this economy in this situation and he wanted his money and would get it. He also told me that our reasons for returning the vehicle were not good enough for him.

I recently sent a certified letter to the President, which has been received, but I have had no reply as of yet. Mr. Smith told me he is taking me to court and guaranteed me he would get his money from me.

What makes you think that this company is under any obligation to modify your loan? You signed a contract to make payments of a specific amount on specific dates. If you don't do that (whatever your personal circumstances), it's your problem.

If you return the car, you will still be on the hook for the difference between what the car sells for at auction (usually not much), and the remaining balance on your contract. If you truly do not have any money, they may get a court judgement against you, but they won't necessarily get their money.

You suing them because they won't modify your loan is pretty farfetched.
