  I CALL THEM TO PICK UP THIS CAR ON 11/21/2011 THEY GIVE MY THE RUN AROUND SENDING ME TO DEFIANCE PEOPLE BACK AND FORTH NOW IT 1/4/2012 THEY STILL HAVEN'T CAME TO PICK IT THEY SENT ME A PAPER THEY WANT MY TO SIGN AND SEND BACK THAT SAY THEY CAN PICK IT UP BUT I HAVE TO PAY FOR ANY DAMAGE TO THE CAR I AM NOT GOING TO SEND THAT BACK TO THEM. WHO TO SAY THEY WANT PUT SOME ON IT TO MAKE ME PAY I BOUGHT THIS CAR IN 4/12/2008 A 2006 FORD FUSION WITH 16,684 MILES NOW IT ONLY HAS 63,993 ON IT NO DAMAGE AT ALL AND THEY STILL WANT ME TO PAY $12.000 ON IT I JUST BECAME DISABLE AND DRAWING SOCIAL SECURITY AND NO LONGER CAN AFFORD IT THEY WILL NOT PICK IT UP.          

  PLEASE I NEED HELP WITH THIS IF THERE SOMEONE OUT THERE THAT CAN HELP PLEASE CONTACT ME!

 OK here goes.

 CPS love to work outside the law. 

 1) They phone friends and family and disclose your debt. You can take then to small claims court for this and get up to $1000 per offense, just make sure you can prove it.

 2) They try to re-age debt that is no longer collectable in two ways,

     a) They try to convince people to make even a dollar or two in payment which then legally re-ages the debt.
     b) They post a report on your credit file reporting a payment when nothing has been paid.  This is a Federal offense (Fraud) and is punishable by up to $50000 in fines and up to 10 years inside for the person doing it.  The problem is finding out who did it, which is what they rely on.

 3)  They repossess the car and sell it then add exorbitant fees, non existent damages and interest at over 30%/month trying to make even a few hundred dollar debt into thousands as fast as they can.

 I would advise anyone trying to deal with this bottom feeding company to not try to talk to them, but instead ask for proof of the debt including the date of the last payment (if it's over 7 years in most states then they cannot collect).  Or if it is valid check with an attorney who accepts legal aid to see if they are at fault and not you.

 Finally if you check your report and see a sudden report from them appear make sure you print it out.  I did this and my attorney is having a really good time preparing a court case that will result in them actually paying me ;)

I did the same thing but they ended up repoing the car (2 years ago).  Then they filed a complaint against me for money (after I was notified the car had been sold).  The complaint was dismissed without prejudice in December 2010.  Then a week ago I got served and they are trying to reopen the case - TWO YEARS LATER?????????????????????????  This is unreal
