You are really going to ask on a public web site why you are getting sued.
Well okay on the off chance you are serious, the reason you are being sued is because you failed to pay on your loan. The reason they waited a year was because they gave you a year to make good on the legal promise you made.
You see the time to decide if you can afford a car is BEFORE you sign on the dotted line. Because once you sign..you are responsible for the payments regardless of if you can afford it or not. Whether they come and get the car or you turn it in, it is considred a reposession. By law they then must sell the car at auction, and at auction you are lucky if you get 1/3 to 1/2 of the value of the car. Now, this amount is deducted from the loan balance, but YOU are still responsible for any remaining balance.
If you fail to still make the payments on this balance they can turn you over to collections. If you still fail to make your payments they can, and as you have found out they will, file a suit against you. So what ever you do DO NOT miss this court date because if you do you will have a default judgement against you and the next thing you know you will have either your wages garnished or your bank account attached.
Oh and if you say.."well they never tried to collect"..that is 100% BS. If you read reports from other "Deadbeats" they apparently call and call and call to get them to pay. So are they lying?
