Curves For Women ripoff I got hurt getting of machine. They say they are'nt responsible, won't pay any medical bills. Need operation to correct injury. Ft Wayne Indiana

On March 22, 2004 I got seriously injuryed getting off a machine. The machine can over on top of me injuring my thumb. I need surgery to get use of my thumb back.
Curves is saying it's not there fault the machine fell, therfore they should'nt have to pay.

It's been months since this injury.
If this happened exactly as you say then Curves should probably pay for the bill, even if it's as a result of your own clumsiness. That would just be the courteous thing to do.
If the machines were somehow at fault (which I don't believe has been demonstrated) then they'd be liable for more.
Your statute of limitations to collect anything is running out. If I were you I'd being putting EVERYTHING in writing, sending copies of your doctor bills to Curves certified and asking that they help pay (do you have insurance?).
In any case, this sounds like an iffy case legally but if you truly believe they were at fault you need to consult with an attorney. Sometimes just a letter from an attorney is all it takes.

If the equipment is faulty, then yes, you should have every right to be compensated for your injury. This is assuming, however, that the contract you signed doesn't release them from liability.
Come on, you're a grown adult, learn to get on/off workout equipment.
