i got a card from this company in 99. i started with a $4000 limit. i would mail my payments on time yet it would take 2 or 3 weeks for them to put my payments on record, causing them to be late. when i was so called "late" with only a few payments, my limit was dropped to below the balance. this is illegal. i tried calling many times. they refuse to give any assistance whatsoever.

now my balance is spiraling out of control. my husband called to let them know they were employing illegal practices, and they said "i know" but did nothing. until i moved and changed my number, they were calling everyday several times a day. i have not used the card in over 2 years, not to mention it has been expired for almost 2 years, yet i am being charged over $100 per month in finance charges, over the limit charges, and late fees whether i pay them any money or not.

all i have been able to afford to send has been $100 per month, but my balance continues to rise!! i have made numerous attempts to call the company. they are ALWAYS rude, inconsiderate, not to mention they lie often. i have called the only number listed on my bill and on the back of my card and they always tell me i need to call customer service. when i ask what the number is, they give me the same number i called!

i am at a loss and i have no idea what to do anymore. because of this, i cannot buy a house, car, or take out a loan for anything. from july 10 until sept. 18 my balance went up more then $300.

Rick, You Seem to Have Forgotten About The Lawsuit DMB LOST!

I wouldn't sit there being so high and mighty about what you are "legally" allowed to do. It's ironic how quickily you forgot (or don't want to mention) the multi-million dollar class action lawsuit that DMB lost in May of 2002 for it's illegal practices. A Supreme court judge ruled that your banking practices were unethical and illegal and awarded consumers damages for late fees, over the limit fees, etc. they were charged. Guess someone DID agree that those charges are illegal in a many cases. It also doesn't take a rocket scientist to sit down and do a search to find out what a creditor can and can't legally do. Don't be so condescending.

As for charging all the fees you want. GET REAL! No government agency would allow ANY company, bank, etc. to do that. It's called regulation. As for raising the APR, by law, you are to notify the party, IN WRITING, of any such raise. Funny, when my husband's APR junped from 24% to 30% last year, we received NOTHING.

Here's a few truths for you. We had to move to temp housing in 2001 due to severe storm damage to our home. The mail forwarding was screwed up, and we never received out statement for the month of August. My husband called and explained that to a not-so-nice customer service rep who called him a liar. Why be rude from the start when he was showing that he wanted to pay the bill, ON TIME, and he got called a liar? Sure, they sent a new statement out to us, postmarked the same day the payment was due! They had 3 weeks from the day there were notified. Why didn't that person tell him then that he could go online, see his statement, and also pay the bill? Nice omission to be able to collect another late fee. I din't find out about that until I went online right afterwards and discovered it myself.

As for the rudeness. In the 4 years he has had the misfortune to have the credit card from DMB, he was never ONCE treated with anything but rudeness and arrogance. Even if he only called to ask a simple question, the treated him like it was an inconvenince for him to call and them to actually have to do their job, customer service, NOT customer degredation.

Then let's get into all those "offers" that were charged against his account without him realizing it? They were always added RIGHT AFTER the statement was sent, many times putting him over the limit. He wasn't using the card, therefore did not notice them until I went online to make a payment. These were services OFFERED, NOT mandatory. He never agreed to them or signed any paperwork. He would have to wait weeks for them to remove the charges for services he never signed up for and the over the limit fees they caused on several occassions, minus one we are STILL waiting to be removed since March of 2002. But they not once offered to remove the daily finance charges that accrued. Had he gone to use the card and it would have set him over the limit, it would have been refused by DMB. So why would you allow charges, knowing the same, just because they were from one of your partners in crime? Nice way to tack on that over the limit fee is all I can see.

If what you are doing is so legal, then please explain who someone whose credit card is on a monthly billing cycle can have 32 days in that cycle? Last time I knew, no month in the standard calendar used in America has more than 31 days. Another nice way to add on more interest. We have other credit cards on monthly cycles. Each one, the day due is also the end of the billing cycle and that statement is closed the following day with everything posted against it. Why does it take DMB up to 10 days to post a statement? Another way to make someone think they have more credit than they do and allow them to charge something, then a few days later be over their limit after everything FINALLY posts to their account.

Seeing that you don't want to be preached to by someone that doesn't have a law degree, I would have to ask if YOU have one? I doubt it. Your s****.>

I am a collector for DMB in Tulsa and you don't know how many people I talk to that think they know the law. As collectors we have to go through very thorough training when it comes to the law. There are laws that we have to abide by for every state and when someone calls to say what we are doing is illegal it just proves their ignorance. As far as your payment being posted late..I doubt it..mail it earlier and that wouldn't have happened. Also, I seriously doubt that someone agreed with your husband that we use illegal practices. If you think the TRUTH is a lie because it screws your credit maybe you shouldn't have signed up for the card. I'm not trying to go off on you in particular..just everyone like you who I have to deal with on a daily basis. If you would have READ your card member agreement you would have known that we can raise the APR, lower the credit limit, charge all the fees we want yada yada yada and you AGREED to it. Do you just sign a contract for a car without reading it? Then why did you do it for this loan? Now as far as being rude..only if you are rude first are we ever snippy. That is because you are most likely dealing with COLLECTIONS and we don't have to be nice. You owe US money...why should we be nice if you're not paying? You wouldn't be nice to a friend who screwed you out of lets say 4000 bucks would you? Most of the time we are however. We are, or at least try to be, Friendly but Firm. I am not saying we are the best in the business...I've seen some people I've wanted to help out but couldn't due to company policy but we are not as bad as you think. If people would take the time to read what they sign then all this could be avoided. Also, if you don't have a law degree..don't preach to me what is legal and what is not..I probably know a little more about that than you do. Oh, and think about this one, we don't outsource people who don't pay for about 4 to 6 months. We deal with it internally. We don't have to abide by the FDCPA, but we do. We are not a collection AGENCY, we are the company. Be thankful we don't send you people out to other actual agencies. The would be a lot more aggressive and unfriendly.
