Below is what I posted to their website when requesting an RMA and full refund.  COMCAST indicated to return the modem to their nearest location as they confirmed it was indeed their modem (via SN and CMAC) and the fact that "xfinity" is inscribed all over the modem.

The Cisco PDC3941T (SN 275958283, CMAC BCD1659CAFAE) is still associated with a Comcast user account in Atlanta, GA per the Comcast customer support supervisor with whom I just spent an hour on the phone. Needless to say this modem cannot be activated for use on Comcast.

I specifically asked if this is new equipment as your website clearly indicates (screen scrape taken for investigation purposes) and was informed that it was indeed new. This is clearly Cisco gray market equipment that is owned by Comcast.

Comcast has initiated a security investigation based on my call and information provided to include the screen scrape and a copy of my purchase invoice.

Additionally, I am opening a complaint with my credit card company for the total invoice cost of $199.94, contesting it as fraudulent sales practice and am reaching out to my contacts as Cisco HQ (senior Cisco engineer by trade) to inform them my findings also.

Please, to make it easier on you, fully credit my purchase back to my credit card immediately and provide a confirmation with transaction code that this has been accomplished. This is non-negotiable.

I will wait to hear from you on how to dispose of the gray market cable modem.

Below is what the vendor responded with regarding my RMA request.

Please view our return policy and your welcome to return the item to the return address below and feel free to submit any documentation that validates this unit as a "grey market" item and we can issue a full refund and reimburse your return shipping charges upon the return of the unit.  We take these accusation very seriously and so we need the proper documentation and statements for legal purposes so we can further investigate the matter.
