A scam I believe worthy of your attention is the HOME WARRANTY. There are many of these company's and it is a growing industry. Like any other, it is a mixed bag of those that are honest and those that are not.
I am concerned with the tactics of ECM, or East Coast Mechanical, 1500
North High Ridge Road , Boynton Beach, FL 33426
They sell you "Replacement Protection" for your home appliances. The sales pitch is that if an appliance, for example your Central Air Conditioning breaks down and they can't fix it, they will replace it with a new system with similar features. This "Replacement Protection" concept is what they use to entice subscribers and what you pay for.
The contract with ECM states that certain exclusions apply. This is the loop-hole that prevails. Your system will not be covered by the warranty, and ECM, who just happens to be, according to their web site, the largest Trane dealer in Florida, will sell you a new one...if you let them.
This is a flagrant conflict of interest when the company responsible for replacing a failed system also sells new systems, and independently makes the final judgment as to whether or not your system qualifies for replacement under their warranty.
My mother was sold this kind of warranty by ECM. She was left after the sale with the impression that she had "Replacement Protection" on her central air conditioning system. After paying for this "protection" for years, her ac system broke down. The warranty company technician said they couldn't fix it, but that the reason for the breakdown wasn't covered, and that she would now have to purchase a new ac system. An 82 year old faced with fighting and going without air or purchasing the new system...which was installed in 1 day...made the only choice she was left with...this is just wrong!
I hope you will give this company and this industry the attention it deserves.

After further research and understanding the terms and conditions of the "home warranty" that my mother has had with ECM for the past years I would like to retract my previous claim that "ECM is not an honest company and takes advantage of the elderly".
In fact her air conditioner did not suffer mechanical failure; the evaporator coil was dirty. I have found that this is a common problem with air conditioners if they are not properly maintained and our unit was 10 years old which also elevated the problem. The repair technician left her unit operational and gave her options to clean the coil or upgrade her system to a new one. The repair technician had left the home, and my mother and brother, who were at the home, called him back to review the replacement option. My mother at that time chose to replace the 10 year old unit with new one.The system was installed at her request the next business day, Monday. I posted this report prior to discussing my concerns with the "management team" at ECM. Once I was able to meet with them and they explained what took place we came to a satisfactory solution. my 82 year old mother is very happy with the new air conditioner and I can say that ECM did go out of their way to satisfy us both.

I have filed suit against East Coast Mechanical...their rebuttal to my filing with the BBB states that the Replacement Protection Warranty was not an issue because my Mother simply decided to upgrade, (big lie) and that there was nothing wrong with her air conditioning system.
They are lying...I will do my best to convince a jury...I have demanded a jury trial. I hope they smell the rat and find in our favor.
