EMC Semi backed into my daughter and rather is waste time going to court

A semi backed into my daughter and the insurance for the driver is EMC and won’t pay. Semi driver has numerous violations and my daughter has none. He was on the phone at the time with no flagger and his negligence totaled her car leaving her injured. It was reported him on the phone per phone records and she wasn’t.

Instead of them paying for his negligence almost 3 years later without paying a dime we have to sue. If that was your 18 yr old would you want your insurance to take care of your injured child? Of course, and instead they’re making us fight in court. Now we had to spend money to prove the driver negligent which we have the proof but how irresponsible can you be of an insurance company to hold out like that.
