I am one of many people taken by the sell off of my credit card account from Providian to Emerge Mastercard. My rate was jacked up to 29.99%. There is nothing I can do about this, so I am told. Today I received a call from Emerge saying that my payment from last month has not been received. I open my online account and look for the check.

The check they say they did not receive had indeed been cashed before the due date by Emerge. I have a photo copy of the check, both sides. It shows the Emerge FDO stamp and all corresponding bank stamps showing it cashed and cleared before my due date. Are these people serious? Did they think I would lose the cancelled check and not have proof that I paid on time? This looks like a game to me.

Kind of like they are playing the odds that some of us will not have the records to show payment and will just pay the late fees and penalties just to get them off our backs or something. It's no secret that most of us that were Providian customer and now have Emerge accounts were not stellar credit accounts. Most of us were trying to rebuild our credit. Emerge has taken advantage of this and knows that people in this circumstance will probably pay a small amount of money that we don't even owe just to not get our credit history dinged again after rebuilding to what ever level we have ascended to today.

This is horrible; this is an outrage and should not be allowed. Somehow I get the feeling that it's not legal either but what's the little guy going to do about it? Probably not much, lawyers cost money. People who are rebuilding their credit don't have extra money for legal fees. A class action law suite would probably end all this if an attorney with some clout would take this thing and run with it.
