State Energy Conservation contracted to Provide a solar Water Heater that would Lower Electric Bill 50% a month. The terms of the Contract were if we did not gain such savings, we can, if in writing, get back our original water heater or new like model and owe nothing. The terms of Financing, in the contract were 7,500 with first year no charge and thereafter for 2 years a rate of 1.25 percent per year. Unless Unit did not perform and was turned in. Financing done through Enerbank USA an State Energy Conservation Company affiliate. We Wrote to Energy Conservation and demonstrated there was $0 (ZERO) savings and wanted our original unit or replacement back. They hid from us and then Enerbank subsequently, after not receiving any more payments, litigated under and using a fraudulently falsified document for payment and interest that are/were completely inconsistent with the signed contract. A document that was never seen or used or part of any contract signed with the now Respondent. How these large illegal companies can manipulate the legal system to defraud the public Is beyond me.

EnerBank Response

AUTHOR: Andy G. - ()

POSTED: Thursday, October 30, 2014

Thank you for bringing this matter to our attention. Our goal is 100% customer satisfaction. EnerBank USA (the “Bank”) is not party to the project contract; therefore, if the customer has concerns regarding an agreement made with the contractor, we encourage the customer to contact the contractor directly to resolve the matter. Additionally, the Bank is not affiliated with the contractor other than to provide payment options for their customers.

In order for the Bank to release funds to a contractor, the borrower and contractor must both sign a Payment Authorization Form confirming that the work has been completed. This becomes a separate contract between the Bank and the borrower, in which the borrower agrees to repay the loan as outlined in the Note & Disclosure Statement provided before the loan is funded. Should the borrower choose not to repay the loan in accordance with the signed agreement, the Bank may, at its discretion, pursue various methods of repayment.

Unfortunately, we do not have enough information to call you to further address your concerns. Please call us at 1-888-390-1220 Mon-Fri 9:00 AM – 8:00 PM ET so we can immediately assist you. EnerBank USA maintains an “A+” rating with the Better Business Bureau, and to us even one unhappy customer is one too many.
