I was empressed with Estrela Marketing Solutions when I first started talking with their Marketing Manager John Keith. He seemed like a good guy and they put together a nice email to promote our business. We paid them $1400.00 to send out over 13,000 emails to commercial printers that had opted in.

Well we got not one person to respond to our email and I questioned them about it John got real defensive. Then they sent me a report detailing the amount of click throughs from the email to our website, only thing they did not know our website tracks the reffering traffic and guess what we could account for every click though on our site on the days they claimed that we had 156 people open the email and go on to our site. But guess what our site only had 85 click through on those day and all the reffering traffic can be confirmed that they were from the ads we placed on google, bing and yahoo.

So their report was a bunch of BS. Next they try and pass off a Affidavit notorized by their bank, in which the notary says he saw the raw data to prove that they had sent the emails. I will dispute their charge with our credit card company. I hope they try and take me to court because the Judge will laugh them out of the court house, when he compares their phoney reports to our websites traffic reports.

I just wish I would have checked out the rip off report before I got hooked up with these scammers. Well at least I know I wasn't the only one to fall for their BS.

Now what their President will say I must be some competitor. Same answer he gives to all the complaints

Partial refund recieved from Estrela marketing

Mr Adam Taub CEo Of Marketing solutions, refunded $933.00 of the $1400.00 dollars I spent. Sometime even a partial credit is worth accepting. Pushing for a full credit would have just taken more time than Adam & I had the stomach for.No one but the lawyers win when you have to go to court.

 I will just mark it up to a lesson leaned. As far as me not telling the entire story I find that statement false , but am willing to end this dipute now and go on to bigger and better things.If things charge I will let you know, but as of now everything seems settled

This issue has been resolved. Mr. Morgan accepted my resolution and I have issued a 2/3 credit back to Mr. Morgan's credit card.

Mr. Morgan is not providing the whole story. He is very abusive to my staff and we are trying to help him!

I have been trying to work with Mr. Morgan but he is insisting on being abusive to me and my staff. I have no problem refunding 2/3's of his contract since he contracted us for 3 mailings and we have done 1 of them.

I am putting this offer back to him and I hope he decides to accept it.

I will post an update as soon as I hear back from him.

Ok so I checked our non-referred traffic from the same dates, 6/16-6/22 and the click through was only 31 views including the pages you had links to. And I have many customers that have business cards and flyers with our web address so there's no way we could even determine that the 31 views was from your email. Given that 31 is still a lot less than the 152 you claimed on your report.
 
I too have been to court before and have no problem in proving my case with my figures. Or you can supply me with the 13,000 plus emails of your opted in Commercial printers and we can check with the ones who are current customers of our to see if they received the email.
Now I sure you will say that is against the spam laws and yada yada yada, but if the opted in there is no reason you could not share the info with me so we could resolve this without further problem should your claims be true. I have talked with many email marketers and they  guarentee they will show me exactly where the email was sent and which ones were opened or I need not pay.
 
So sorry if you feel offended, but I still feel that you did nt do what you promised. So again I am asking for a refund unless you can prove to me with email addresses we can verify. And don't even try visiting our site because we can track
 
If you are as concerned as you say about keeping your good name, then issue me a credit and we will be done with it.

These are the redirects used to track clicks from your ad. Please keep in mind that it seems that your analytics do not have the capability to track these visitors down from a referrer in the emails since the URLs being used in the ad are original URLs. For example, when you do an ad with Google Ad Words or Yahoo Search Marketing, they code the IP address of the visitor with their unique identifier that allows many different log analyzers to show where it came from. In a case where the visitors are coming from an email which could be from Gmail (which is Google) or Yahoo Mail, there is no way to identify each one by referrer from the email itself.

Go ahead and go back to the approval and/or live seed email we sent you originally and about 10 minutes ago. Make note of how many opens and clicks there are on our reporting. Then go ahead and open and click on the ad you received from us originally. You will see the number update in real time. These results are data base driven and are as legitimate as you can get.
 
We have been in business for 7 years and have ran thousands of campaigns for thousands of different advertisers. We have only had to prove our tracking legitimacy one time in court, and it was found to be completely legitimate and true to form. We are not fooling or scamming anyone. It does us no good to provide false tracking to any advertiser. What can we prove by doing this?
 
There are cases that our customers expectations where high to start with and they were disappointed in the results of the mailing. In cases like that, we try to get you the best response possible but simply cannot guarantee this. No advertising medium can.
 
If you are not pleased with the response from your 1st mailing, I can certainly help get the response rate up and are more than happy to authorize more names and more launches if needed for you to get a return on investment.  What I am not okay with is being accused of scamming you and that my reporting is BS. If you were in my shoes and your companys integrity was called on the carpet, you would want to defend it rigorously as well.
 
I am happy to explore ways to help this campaign get you the results you are seeking. I request that you work with me in doing this and not focusing on attempting to prove we are scamming you. You will find we are great to work with when you give us a chance to work on your campaign.

As you can see from our websites referring traffic report below we  had our webpage opened 121 times in the time frame of 6/16-6/22
but your report  shows 234 opens and 152 clicks. How is that even possible when we know that there were only 121 clicks that can all be accounted for from our other advertising such as our ads on google, yahoo, bing, ebay, and our banners on some of the printing  e-zines. And I pay each time a customer clicks on an ad from these search engines so I have that documentation to to show your report is totally bogus. You will do yourself a big favor by refunding my money or I will fight this for as long as it takes. I know that I am not the first customer you have done this too. So go ahead and give me some more baloney about your reports. Don't think I will get tired and go away, it's the principal of it to me and I never plan on giving in when I know I did not get what I paid for.
 
My next letter will be to the Attorney General in the State of Florida. I will continue this for all long as you want to carry it on. And no I don't want to talk to you on the phone, because I want all of our correspondence documented.
 
So you do what you want to do and I will do what i need to do.

Your Affidavit of delivery is a bunch of BS. First of all the #'s of click though you show on your report from 6-16-10 to 6-22-10
shows more click throughs to our site that we even had on those days. Our site keep traffic reports on exactly where each click though came from , all of ours were from the ads we placed with Google, Bing, Yahoo and some banner ads we have on some printing publications.
Your report shows that we got 152 click through from 6-16 through 6-22-10. This is more than we had on the site during that time frame and all our click throughs are accounted for.
 
I have been doing al lot of investigating your company and what do you know there are a lot of upset customers claiming the same thing I am. Your figures don't hold water, your #'s don't match our sites #'s.
 
I am disputing the charge tomorrow and I hope you take us to court because  you can't prove you sent 1 email and we have the #'s to prove our referred traffic.
 
You should be ashamed of yourself and I am a firm believer in Karma and you and your unscrupulous boss will have a lot of explaining to do in the here after. God will punish people like you.
 
So if you think you can steal from me and get away with it, think again.

ISP's can take up to 48 hours to deliver the emails but that does not mean that ALL of them take the full 48 hours. I did mention on the phone not to expect any results for another day or two. There is no way to tell ahead of time when the emails will be delivered over that 48 hour period so to say no one is responding and to indicate that you plan on disputing the charge is premature. The first set of emails of three mailings had not even been fully delivered when you sent me the email yesterday.
 
No, I do not think you are crazy for expecting results. But I was extremely surprised (and a tiny bit offended)  by your email that basically accused us of taking your money and then just sitting back and doing nothing. We just spoke that morning about how it could take a day or two for results to come in.
 
You could have very easily given me a call to discuss what was happening with the email campaign instead of claiming we did not send anything out. I understand that this is an intangible product and that you physically do not see the email address. The fact that we can not sell or give you the email address is in accordance with Federal Laws & Privacy Policies. Organizations in our industry must comply with the Federal CAN-Spam Act of 2003 and there are certain things we can and can not do legally.
 
A click is when someone clicks on the link the email that directs them to your website. We will provide the notarized affidavit of delivery on Tuesday and we are happy to send the next set of emails when you are ready.

Your attached report shows opens & click on the 16th -18th so what do you mean when you say how could they open it before they recieved it. According to your report there were opens and click throughts starting on the 16th. You make it seem like I am crazy for expecting results before it was recived but your report shows opens and click thoughs as of the 16th. How does your statement make sense.
 
Yes I am very interest to see the notarized affidavit of delivery  on Tuesday.

The tracking report for the mailing so far is attached. There have been 138 opens and 63 clicks so far. Tracking starts during the testing period so some of these opens and clicks may be from before the emails were actually sent. The link inside the report will update each time you click on it.
 
Regarding your claim we did not do what we promised to do...
 
As we discussed yesterday morning on the phone, it can take two days for all the emails to be delivered. The emails were sent on Wednesday at 11:45 AM. So 48 hours would be Friday,TODAY, at 11:45 AM.
 
Yet you sent me this email yesterday at 5:00 - that does not make sense. How can someone open and respond to your email BEFORE THEY RECEIVE IT. This is your reasoning for claiming we did not do what we promised?
 
If you require further proof I will have a notarized affidavit of delivery provided for you on Tuesday.

I am going to need some sort of proof that you actually sent out over 13,000 emails as promised , I find it very strange that not 1 person would have gone to our site to fill out a contact form.
 
I now become very suspicious that no emails were actually sent. We will need proof that the emails were sent. Something more than just a report from your showing who opened email. We will need at least a sampling of the email addresses that you sent to so we can call those shops to verify that they in fact received our email.
 
We will give it until next Tuesday to see if we get any response.
 
After that you will need to provide us with some concrete proof that the emails were actually sent or we will have no choice to dispute the 1400.00 charge with our Mastercard Bank
