I called Fairbanks Capitol on 4/8/0, in response to a letter I received in the mail on 3/6/04 from a Mr. Ben Noble. The letter was undated, but postmarked on March 2, 2004. I received the letter on March 6, 2004. At the time of our conversation, I had misplaced the letter I received, and was speaking from memory about the content of the letter. I was speaking to a gentleman by the name of Russ, who informed me, my property was in foreclosure. I was shocked to find this out, and responded by saying, "No one has informed me that I am in foreclosure.

I have received not received any information about a foreclosure. I advised him that I was putting a payment in the mail on Friday, March 12, 2004, and he advised me that, "they are not accepting any payments unless I pay the attorney fees first. I would have to pay $2000.00 in attorney fees before they would accept my loan payments. I told him I would call him back on Tuesday. I called back on Tuesday, March 9, 2004 and left a voice mail message requesting the payoff amount on the loan and my number. When I called back today, I spoke with a Micheal Goode. I requested a payoff quote, which he refused to quote over the phone. He stated that there is a fee of $50.00 for them to send me a quote. I advised him that I intending to refinance my loan through another lender, and they need the payoff amount.

I also stated question, why I have to pay a fee to get a quote to pay off a mortgage loan? He advised it was NJ State law, and that the $50.00 would be added to the loan amount. He stated that he would need a pre-approval letter from the lender. I stated,"How can I aske a future lender for an approval letter, when you can;t even tell me what the payoff amount is? He stated he would start a Forebearance aggreement, which would put the foreclosure on hold temporarily, took some financial information on my financial liabilities and then stated, "You need to call back in a week to find out if your approved , and then you can submit your payment. I told him I would call back within the week. I then placed a call to the potential re-finance lender and reviewed what I was told by Fairbanks Capitol. I also advised him that they would not give me a payoff quote and he referred me to this website.
