I have had nothing but problems with my mortgage loan through Fifth Third Bank. Here is the story on how I am currently being scammed through Fifth Third Bank.


I sold my house to a gentleman through a land contract about three years ago. During the first year and a half everything seemed to be going smooth. Fifth Third Bank sent a letter stating they needed prove of insurance on the property or they would have to put "Forced Place" insurance on the house. I provided them with the papers they need. Fifth Third Bank put the insurance on the property anyway which made the payment go from 350.00 to 444.00. The gentleman payed the extra money for the past year and a half.

This past Febuary I received a letter stating there was a shortage on my mortgage account of 133.00. I went to my local Fifth Third branch and asked them what the charge was for, in which they could not tell me. I decided to pay the ammount to ensure my credit was not affected. Well a month went by and a got a email from freecreditreports.com saying I had a negative mark on my credit. I went a checked the report and it stated that Fifth Third reported I was thirty days past due on my account. I called them and they stated they had to put " Forced Place" insurance on the property. The payment went up to 520.00. Again I sent them all the needed paperwork to have the insurance taken off the account. I have talk to everyone in the mortgage department about this issue for the past nine months. Everyone said that it should be cleared up and I should not have anything to worry about. Well now The property is BEING FORCLOSED ON! I have all the documentation backing me up in this case.

Chris,

You screwed yourself by letting the mortgage company in on the fact you "sold" the property via a "land contract".

You violated the terms of your mortgage by doing this, and that is the reason for the foreclosure. It has absolutely nothing to do with the insurance issue.

You cannot sell something you do not own. That is illegal. There is no such thing anymore as freely assumable mortgages.

I seriously doubt that you have Fifth Third's express written consent granting you the authority to sell your home on a land contract. That is a no-no and a part of any standard mortgage. That's reason enough for them to accelerate the debt. You need to talk to someone in mortgage loan servicing and / or loss mitigation immediately.
