I made a debit card payment to the cable company. The debit was input as 104, the representative notice his mistake immediately. He put a stop payment on the debit and input a new one immediately of 140. (he simply transposed the numbers). Fifth third recognizes the two debits and has the 104 and the 140 pending. This of course made an overdraft and they have charged an overdraft fee of 37. I do not understand how they cannot not or maybe will not recognize the stop payment as quickly as they recognize the dedit. This over draft is not my fault. A third transactin of 4.96 made the overdraft. Brought the error to 53rd's attention yesterday before the 4.96 posted and they said they could not stop it. Told them about the cable error and they said they cannot do anything until it post (both payments are still pending). In the mean time I get charged the over draft fee plus the additional fee everyday for being overdraft.

Cable Company Liable.

OK, you can ask your bank to reverse the OD and they MIGHT do it-they don't have to. Better yet would be for the cable company to FAX your bank and explain the error; asking the bank to reverse the fee.

The CABLE COMPANY is liable to you for the OD fees caused by THEIR ERROR. You should require the cable company to communicate with your bank to have the OD fees reversed.

If the bank still won't reverse the OD fee, then DEMAND that your cable company reimburse you for ANY FEES caused by their double billing your debit card.

If the cable company refuses to reimburse you for the OD fees, you should SUE the cable company in small claims court-it's an easy win.

BEFORE you sue them for the OD fees, you should make a WRITTEN DEMAND for reimbursement; demand letter sent certified, return receipt requested. Include a copy of your bank statement that shows the OD fees caused by their error (you may black out the account number.) You will need proof that you requested reimbursement for the court.

You are going to need to get a letter from the cable company admitting they made an error. Once you have that you need to go to the branch and show them the letter and they should reverse the overdraft fees. At this point you have to prove to the bank that it was not your fault.
