This is an excerpt of one of the many letters that I sent to First Citizens Bank in Charlottesville, VA.
In September of 2004, I received a notice stating the renewal date of the account as September 4, 2004 and the maturity date as April 5, 2005, I went into the Charlottesville branch and was told very candidly that the account had been closed and that I had no money there. Only after speaking to the manager, was it explained that the account was closed due to inactivity.
They explained that they knew I was in the Military and had been out of the area for sometime. They then explained that I would have to contact the North Carolina State treasury (NCST)to get the money back and provided me with a yellow sticky with the NCST phone number and the date the account was closed (22 Oct 2004). No further assistance was offered.
Shortly thereafter I contacted the NCST and was told that they didn't show an account for me. An NCST employee explained that it was possible that it had not been entered yet so she provided their web site information so that I could continue to check periodically.
Having done this for several months I again contacted the NCST telephonically, again their employee consulted their records and verified there was no entry for me. She then recommended that I try First Citizens again.
I then contacted First Citizens and requested that they issue all funds due to me. I further request that they consult VA regulation concerning revolving accounts and
Certificates of Deposits, and that they would find that their company failed to adhere to regulatory notice requirements, and otherwise acted prematurely in deeming the account dormant. At the time the account was closed the balance was substantial (to me). I requested this amount plus interest had it not been closed prematurely, be refunded to me.
I closed with," I sincerely hope my interaction with your banking institution is not normal business practice. Similarly I think it a poor excuse for an establishment to use the fact that someone is in the Military as an excuse to treat them poorly or to deny them the rights guaranteed them by law, i.e. proper notices.
I have not had the time to file claim in a court of law, but plan to do so soon as I feel three years and exhausting all avenues available to me other than litigation have been attempted.
