I recieved a arbitration award against First National Bank of Omaha in August 4th of 2004.
in Nov of O4 I was contacted by a collection agency. When told of the arbitration award, he contacted the bank and was told by them that it was sent to him in error. He then sent me a letter showing a zero balance.
In Feb of 2005 I was contacted by another group of collection attorneys. When I told them of the arbitration award, and asked for validation of the debt, they responded with a suit for summary judgement. This is a clear violation of the FTC, as they state that a debt must be validated before suit can be started, and a computer generated credit card statement is not sufficient. Since I was moving out of state at the time, they filed for a summary judgement 7 months after I moved. I sent a letter to the judge, but to no avail. To me this borders on RICO tactics. Anyone want to try it in Federal Court, where they cannot manipulate the jury or judge.
All Federal Offices admit that this was obtained illegally, but not have acted on it yet.

Unfortunately, the only way for you to deal with this is to file a lawsuit in federal court seeking the damages from the FDCPA violations.

The FTC is a toothless tiger as far as individual cases go, they only compile complaints and then act when they get so many on the same person or business.

No one will help you with this. File the lawsuit.
