Hi All,

I have very good info to share with you all.

I am in court w/ Forster & Garbus now. They tried to sue over an old debt that is past the statute of limitations.

They conducted "sewer service", plus with a back-dated date.

They obtained a default judgement, while my answer & counter claim was queued with the court clerk. The default judgement & case will be thrown out by the judge once she speaks with my lawyer.

I expect to win my counter claim. I expect that they will have to pay for all the FDCPA violations of which my lawyer & I have strong evidence of, plus my lawyers fees which will be huge.

It is apparent to the whole world , except the court system that F&G says they serve folks (but don't really do so) & then get default judgements, because no one goes to court to answer because they don't know about the suit.

If this happened to you, you can get a judge to vacate based on this fact.

You can probably also get the case thrown out if it is beyond the statute of limitations. Note: that depends the original debtors choice-of-law - not your state you live in.

For ficticious example: If credit card "X" had a delaware choice-of-law, then there is a 3 year statute as opposed to NY's 6 year statute. If it was Illinois then 5 years, etc, etc.. you can google "credit statute of limitations" and see the full info.

Check where your original creditor had a choice of law when your last date of default was.

I may be able to help, send in a post & I will respond.

Lisa - I have been in contact with you.. we will talk.

Anyone else feel free - Together we can get them disbared & take them out of business for ever.

But lets not stop there..... we might have a chance to confront them in court together. Contact me if interested.
