I discovered september 29 that Foxtons is no longer. Evidently it hit the newspapers on Wednesday, september 26. No one has called me or wrote me. I have my house (which is vacant) listed with them for the past 4 months. I went there on sunday, september 30, to find someone had removed the lockbox as well as all materials and business cards of any agencies that had shown the home and took my house key as well. I have called and emailed them several times with no response.
I also bought a home from them in June 2007 so they definitely knew where to contact me. My listing agent contacted me only twice during the last 4 months. Both times to get a price reduction.
I am trying to get a release so that I can try and sell my house. I was a broker for a number of years, and familar with the importance of keeping in contact with your clients. the news paper states that they will retain 30 agents to service 4000 listings. I don't know where to go to get a release from them. I had realtors that left business cards in my front door this weekend that tried to show the home but could not gain access due to the lockbox being taken. In a market that is this difficult I can't afford to have prospective buyers get away.

I went to their corporate headquarters at 185 Route 36 in W. Long Branch and asked (nicely) for an unconditional withdrawal from the contract. I received it right there at their offices. Good luck.

FOXTONS ----THEY HAVE GOT TO BE JOKING

Just received an email from Mark Horvat, Vice Preseident of Sales, stating that they were going to "re-assign my listing to another broker".
He continued to state that all terms of the original listing agreement would be binding.
As I see it, when they took the lock box off my home(which is vacant), all their brochures, as well as my house key which was in the lockbox, and failed to notify me, they are in breach of our contract. As it stands right now, my home cannot be shown, as there is no access.
Within the next fifteen days, this transition should take place. So I should just sit tight, while they figure out their financial status.
How thoughtful.
