I am so mad...Franklink Collection Services is the most unethical and unprofessional business I have ever heard of. If in fact they are a legitimate busioness. They contact my husband regarding a bill from BellSouth telecommunications from an account I closed that was in my maiden name. I am reporting this here because I read about several other people who expericenced the same thing. Long story short, they have threatened to garnish my wages, sue me and continue contacting me. I have put my request for an itemized statement of sais debt in writing to this so called company and was still threatened with a lawsuit if I did not make payment arrangemnts. I informed them that when I recieve the itemized statment I will either dispute it in writing or make arrangements to pay it if it a valid charge. They said they will provide the statement but begin proceedings of lawsuit anyway. These people are scum!!! I know my rights as a consumer and have reported them to the BBB, the Federal Trade Commission and here. Any suggestions????

Laurie, you need to show a little patience, and respect for others. Just because you may think you know the ins & outs of a particular situation does not mean everyone does. Most people do not know how to get a situation resolved, that's why sites like these were created.

To the untrained eye, these laws are not only vague, but confusing to most people. I, bet I can come up with contradictory sections of collection law that would confuse even you. There are about 75+ sections (not counting various state laws) on the books to date, and growing.

Patience Laurie.

Your further aid, and reference was on the mark. However, State Law does not supersede Federal Law. If ever in question, go with Federal guidelines, and law first.

Read the FAIR DEBT COLLECTION PRACTICE ACT on the Federal Trade Commission website. Also research STATE OF FLORIDA Law as well. The information is out - YOU ARE NOT LOOKING FOR IT.

note this only applies to 3rd party debt collectors -NOT THE ORIGINAL CREDITOR.

The laws are rather vauge on collecting a debt. I reside in Florida, can anyone help me with the laws here on an unpaid utility debt. I have owed before and NEVER, EVER been treated the way these slime balls have treated me. Credit Card companies which I would think would be tougher than a supposed unpaid phone bill are not this way. HELP!!! I have waged a war against these people and I intend to stick with it.

They cannot sue you if you demanded debt validation.

The fact they start with threats tells me its an old legally uncollectible debt - that they cannot provide validation on.
