So i purchased some computer equipment from fry's, and there was a problem with the bank and the check did not go through. fry's did not try to contact me directly (even though all of my contact information was clearly marked on the check) they instead sent a claim directly to a sleezy little lawyer named Paul Stassinos.

I then saw on my bank statement that the check bounced, and went and paid the debt. Paul Stassinos and Fry's still continued the collections (even though it was paid in full, including a bounced check fee) they went ahead and got a wage garnishment for 4x the original amount ($600 originally, they're stealing $2100), and have collected 1 payment so far. i have sent certified letters which included the reciept of payment to the law firm, fry's, as well as the courts, and no one seems to care.

Fry's has terrible products, unknowledgeable employees, the only thing it's got going for it is 1 out of every 10 items will actually work. now they've added fraud and robbery onto their impressive list of great traits. i have spent over $80k over the past 10 years with fry's, i will never spend another dime.

You should have gone throught the attonrey to begin with regarding the payment once they sent you the letter regarding the bounced check. After they, you should have gotten written confirmation from them about the dismissal of the lawsuit.

It still may not be too late. Go to the clerk's office the can give you a motion form to set the judgment aside. You need to ask the court to set aside the judgment. You need to explain your story, mainly that you didn't show in court because you showed them proof of payment and you thought they would drop the lawsuit. The court clerk will set a hearing date and notify Frye's and/or their attorney. If it works out well, maybe you can stop the garnishment and get your money back.

Something doesn't smell right...

Your story doesn't add up. Bounced checks are covered by California Civil Code Section 1719. If you bounced a check, then the recipient of the needs to send you a certified letter. You have 30 days to make the check good, pay a $25 blank check fee and the cost of mailed the certified letter.

If you don't make the check good, the store can sue you for the check plus treble damages with a max of $1500. A creditor can't get a small claims judgment until they serve you. If you got the certified letter, you either didn't follow the instructions on where to send the payment (bad idea), failed to get proof of payment (bad idea) or you didn't pay within the 30 days.

Then, you got served with the small claims lawsuit and didn't show up in court (bad idea). If you claim that you weren't served or had a good excuse for not showing up, you can file a motion to set aside the judgment. If you went to court and lost, you didn't have enough evidence to prove your and/or you lost your appeal.
