On October 15, 2001 at about 3:45 p.m. I went to the Furniture Max store at the Office Max, which is located at the northwest corner of Alma School Rd. and Southern Rd., in response to a flyer that advertised a "Fall Furniture Clearance Event!" I was specifically looking for some items advertised on the flyer.

I was met by Chris in the Furniture Max, and I told him that I wanted to see the clearance items. I wanted to get a folding table and a nice cherry filing cabinet. Chris told me that they didn't have any. When I pointed out the advertising that said they did, he told me those were only examples of things they might have on sale.

I then asked to see the supervisor. An individual named Raymond met me and told me that they did not have any of those item for clearance "right now." I confronted him with the flyer that clearly stated that they had "Files" and "Folding Tables" on clearance. I also pointed out that this was a bait and switch advertisement. Raymond said that there was nothing more he could do. Perhaps I should check later.

I took the flyer with me and left. I do not expect that I will be able to ever get satisfaction from them voluntarily. I am sending a copy of the flyer in hopes that you can help me.

Empty Promises, but no Delivery

Contact was made with them by BADbusinessbureau.com people about their deceptive advertising practices and they promised that they would do better than honor the deal, they would give me the items free. The spontaneous graciousness was a ruse to get us off their back. Now there is not further contact on the deal. I wish I knew who to trust. I just want them to honor what they say.

I am also a victim. I received a green flyer for the furniture clearance sale at my door on Monday with other advertising. I am especially furious to learn that I not only traveled a great distance out of my way needlessly, but others were lured to the store in this illegal fashion.



I was looking for some nice office furniture and a folding table, and went to the Phoenix store. When I asked the associate if another store might have the items, I was told, "Oh, I really don't know why they put those flyers out. We never had any of those things and nobody else really does either."



I really think there is a very good case for bait & switch. If there is any sort of class action suit, count me in.
