I received today a letter trying to collect a debt in the amount of $66 on behelf of Virtual Data. After reading all of the complaints on this company, I am most interested in filing a class action lawsuit against both Galaxy Credit and Virtual Data. If anyone is interested, please contact me by using the rebuttal box below.

I am in active contact with two lawyers:
1) My bankruptcy lawyer as I am very recently discharged from a bankruptcy and all of my debt was claimed in the bankruptcy.
2) the company I work for corporate lawyers who are well versed in consumer laws as we are a manufacturer. They have been lead counsel in a number of class action lawsuits and have had great success in shutting down companies who perpetuate this type of fraudulent business.

I am most interested in seeing if there is a common link between all of those targeted by Galaxy Credit. Recent bankruptcy? Magazine subscription purchased on E-bay? State of residence?

I am in Illinois. My Chapter 13 was filed 3 years ago, and was just discharged a little over 2 weeks ago (a coindence that Galaxy mailed me like a week later?). I was a direct subscriber to Playboy approx 4 years ago. I purchased a subscription to Backpacker magazine off of E-bay approx 3.5 years ago.

If interested in a class-action lawsuit against these companies, please e-mail me with your general information. I am very serious about this - I worked too hard to pay my Chapter 13 100% and two years early to let some fly-by-night joke of a company try to get free money from me or to try to ruin my credit report. They picked the wrong guy this time.

I will be filing a complaint with the IL attorney general first thing Monday morning as well as a complaint with the BBB. As consumers forward me information, I will compile a list, post here, and forward to both of my attorneys. If there is enough interest (and I think there will be), I will also start a web-site with message board on this so all can stay updated on the progress.

Let's band together and not only shut this business down, but make sure the owners pay for their fraudulent actiions.

POSTED: Monday, November 01, 2004

I spoke this morning to Ralph at Galaxy Credit who verifed that my $66 debt was through Virtual Data from a Playboy magazine subscription I agreed to in 1998. When I requested proof, he told me I needed to write to Virtual Data in Chandler, AZ.

Today, I have done the following:
1) Sent letter to both Galaxy Credit and Virtual Data demanding proof of debt and that my account be cleared and closed.
2) Filed complaint with both the Illinois and Arizona Attorney General.
3) Verified with Playboy that my account was always current with them.
4) Playboy also verifed that Virtual Data is not an authorized provider of subscriptions to their magazine.
5) Playboy also stated that they have received 100's of complaints, and are working in conjuction with the Illinois Attorney General to stop these actions against honest consumers.

I strongly urge anyone who receives one of these letters to file complaint immediately with their state's Attorney General as well as with the Arizona Attorney General. We cannot let these companies get away with this type of business - it's deceptive and unethical.
