I am presently in the fight of my life against this company. GMAC has been trying to steal my home for the past nine years.

They admitted that in 1997 they failed to collect hazard insurance(which was suppose to be included as part of our escrow payment).They then decided that they would combine the payment for that year with the coming year which create a large shortage of $6,0176.76. They then increased our monthly escrow payments from $320.75 to $732.36. Even though we managed to pay the extra $411.51 for over a year, eventually, it became more then we could afford. We tried in vain to work out something with them.

GMAC foreclosed on our property and without our knowledge illegally sold our home on the court house steps. We took them to court and the judge rescinded the sale. He also told them, that since we were pro se (representing ourselves), for them to write the order to vacate the sale and set the record straight. Which they did except for one little detail which they somehow over looked, they failed to re-convey the title to us. GMAC held title to our property for five years.

I'm going to cut to the chase and get to the crux of the problem. After successfully completing a five year bankruptcy and paying their claim of $51,000.00, they're still claiming we owe them over $23,000.00 and are threating to foreclose on our home again.

I now have a motion before the court asking the court to determine if GMAC has violated the automatic stay, RESPA, committed fraud, extortion, and if they have been grossly negligent and have breached their fiducary duties.

The judge has said that their actions are probably the result of a large company just not knowing what the other department is doing resulting in "honest errors and inadverent mistakes". However, he also said that he is setting this matter for trial at which time I must prove that GMAC is guilty of the formentioned allegations.

PLEASE, PLEASE, PLEASE, if you are in a like or similar postion contact me at once. I have a pre-trial hearing date coming up in two weeks. As a pro se I'm trying to fight the good fight but I desperately need your help.

GM and GMAC same old dirty deceptive tricks

The following is based on my opinion and/or facts:

I recently had a similar deceptive problem with GMAC and from what I read on the internet it seems to be a pattern of wrong doing that should be investigated by your States Attorney Generals office, Federal Trade commission, Banking commission, Etc which I will be filing with including Obama's office. Its disgusting taxpayers money was wasted on GM and GMAC they should of went under.
I paid off the entire "remaining unpaid balance" stated on my first statement and then they still want to deceive me for more by charging me improper finance charges,etc.

Consider this a formal complaint and a request for a detailed explanation and analyst of my account. I would like my account reviewed and a returned response in writing for over charging me excessive finance charges and erroneous charges. Consider this as a qualified letter of request. I also feel its deceptive to state on my first statement remaining unpaid balance $23,536.37 along with a amount which every norma common sense person would believe to be the remaining unpaid balance as a final amount to pay on the account as I and every common sence person would believed was the final amount and include finance charges. Why state an amount on the statement if this amount for remaining unpaid balance has no meaning? The word Balance is defined as something left over, remainder. I think its just another way GMAC to be deceptive and over charge a confused customer for days of additional finance charges. I also feel the Pay off amount of $146.82 is wrong and excessive. I spoke to five GMAC representatives and increased in Supervisory rank as I went along (Kieth#kfh663, Ryan#raaqa663, Richard# rkk622, Melanie Dotson branch 622, and Randy Godfrey-operations manager) on October 5, 2009 and three of them informed me of different Payoff amounts for the same Pay off date of October 09, 2009. So if the Representatives cant figure out the correct pay off amount how do you expect individuals to get it right? I think its deceptive that GMAC does not include the Pay off amount for the due date as a Representative agreed with me. I also found the representatives to be arrogant, inflexible, unprofessional, non assistant, etc. Representative Bill said the statement amount stated for remaining unpaid balance is the WRONG amount and I should of went online for the correct amount. This appears to be admitting GMAC is being deceptive by posting this amount on the statement and this same amount was online also in a way to trick people. After this experience I will never use GMAC and/or Ally for any financial needs as it appears GMAC has a pattern of deceptive business practices. Im requesting a refund of this $146.82 because of the deceptive remaining unpaid balance. All representatives refused to waive these finance charges and refused contact information for the Corporate Executives office. I await your reply before filing a complaint with Local, State and Government entities.

GM and GMAC Same old tricks with taxpayers money. I had this loan from my last American vehicle bought from a deceptive GM Dealer.

Send your complaints to Local,State and Governemnt officials and consumer protection agencies and just maybe something will be done.

YOUR SILENCE IS THE ONLY THING KEEPING GMAC IN BUSINESS

To everyone who has read or wrote a Rip Off Report about GMAC and is tired of this company's greedy, unethical, and illegal shenanigans, I ask you to support me in my effort to bring GMAC's unscrupulous behavior to an end.

I have been terrorized, humiliated, and almost destroyed by GMAC. I have literally wept from reading the devastating stories of homeowners who have suffered because of GMAC's treachery and greed.

Help me to help all of us. You can do this by writing to Rip Off Report and telling or updating your experience with GMAC so that I can show it to the Court.

My lone voice is not enough. The Court will only be persuaded of GMAC's guilt if it is presented with evidence that GMAC has made a practice of fraudulently servicing homeowners' loans. I must also convince the Court that GMAC has perpetrated this fraud against numerous people and that there is a strong likelihood they will continue to do so.

I urge you to write a Rip Off Report or do a Rip Off Report Update if GMAC has:
failed to timely post monthly payments received from you resulting in the charging of late fees and collection of additional interest;
placed monthly payments in "suspense" accounts which can result in the imposition of late fees and the collection of a larger amount of interest over the life of the loan;
untimely paid your homeowner's hazard insurance from the escrow and then ordered force-placed insurance at rates higher than the original insurance;
delayed credits and adjustments to your escrow account which resulted in an unnecessary increase in the your monthly escrow payment;
forged or falsified documents or checks
conducted unnecessary "drive-by" property inspections when you were not in default and then imposed a charge, or conducted multiple inspections for one period of default and imposed multiple charges,
ruined your credit by erroneously reporting you to credit reporting agencies as being delinquent in your payments.
These are but a few of the tactics use by GMAC to steal our homes. In its efforts to unjustly enrich its own coffers, GMAC has devised and executed a well-developed scheme to defraud us of our property, ruin our credit, and destroy our good name.

We CAN, we MUST, we WILL stop GMAC!

Let us use this consumer forum to unite and raise our voices as one. Let my one lone voice become the thunderous roar of the thousands of homeowners who have been abuse by GMAC.Once again, I urge you to write a Rip Off Report.

Stop complaining, start writing!

I have read so many reports on this site that it boogles the mind that one company can continuously get away with terrorizing thousands, if not hundreds of thousands, of American citizen without being brought to task and held accountable for its dastardly deed and miscreant behavior.

What are our elected officials doing to stop the unscrupulous practices of a company that is causing property owners across the nation to lose their home while wreaking havoc in their lives. Write your local, state , and federal representative and inform them about what GMAC is doing to you.

Is HUD, the FCT, and any other federal or state agency charged with protecting the rights of consumers, 1) investigating complaints lodged against GMAC in a timely manner and 2)scrutinizing this industrial giant's foreclosure and bankruptcy strategies and procedures. File a complaint with them against GMAC.

HOMEOWNERS STOP RELYING ON GMAC TO DO THE RIGHT THING! It should be obvious to all who have read the report of others on this site that this company will employ any tactic possible to steal your home.

Upon notification from GMAC, or as soon as you are aware that GMAC has made a mistake or error in servicing your account WRITE them a letter. Do not call them. I repeat, DO NOT CALL THEM. When writing this letter include your name, address, loan number, what your complaint is about,and COPIES of any supporting documentation. By including this information you have effectively written a "qualified letter of request". Mail this letter and all correspondence via the post office as "registered mail return receipt requested."

GMAC, as servicer of your account, must acknowledge your complaint in writing within 20 business days of receipt of your qualified letter of request. They must then resolve your complaint within 60 days by correcting the account or giving a statement of the reason(s) why it will not correct your account. Continue to make the payments AS REQUIRED BY GMAC until the complaint is resolved.

I strongly suggest that if you do have to speak with GMAC that you keep a telephone log of your conversations.If they should call you, ask them to send a letter verifying and confirming your conversation. As soon as you conclude your conversation mail them a letter which includes your loan number, who you spoke with, and what transpired during the call.Make a copy of this and all correspondence you send or receive and place them in a folder.

This information, most of which I've taken off the HUD site, should be enough to get you started. Remember, Stop complaing and start writing.
