Homeq Servicing Corp did not applied deferral Sacramento, California

Hi, I had a loan through The Money Store which then became HomEq. When we signed the paper work for the loan we signed a waiver to defer the first two payments. Welcome to my nightmare. 7 years of purgatory followed and my credit is ruined. I have lost over a hundred thousand dollars because of this ripoff company. They didn't put the deferrals into the system so I started getting nasty phone calls.

I explained to the individuals that they had the paperwork and I refaxed copies to them as well. They finally "straightened" it out so I thought. They quit calling. Then they transferred everything to HomEq. When this happened the deferrals were put on my account as being owed money but the due date never got corrected to reflect this. I have documentation of everything and the numerous calls that I made to them to try to straighten it out. When I filed for my divorce, I ended up not being able to keep up with the payments that they were saying I owed and the loan went into foreclosure.

It cost me dearly to get the loan refinanced and I literally lost $1000's of dollars due to it. On top of this my credit is so bad that all of the interest rates that I have a really high. During the course of dealing with HomEq they have lied to me, called me names, harassed me, told me that I didn't pay my bills because I filed for bankruptcy (which I hadn't and was a mistake on their side - they documented my account instead of the person whose name was after mine on the account list). They have imposed insurance on the account and I have had to be at their beck and call to pay whatever they said I owed. Instead of having every payment (according to their records) be past due, I was actually paid 2 months in advance. I am looking for an attorney to quickly and effectively quash them. They have admitted that they made a mistake but refuse to do anything about it.
