Joe Myers Toyota ripoff Sold Me A Jerking Lemon , it's on been a month and a few days and they said AS IS!! Houston Texas

I bought a 95 Park Avenue Buick after saving for months because I lost my car in a hit and run.I did not want to go to a side street dealership because I wanted to avoid a lemon.(little did I know). So I went to a reputable dealership, Jow Myers Toyota thinking that a car from a major dealership would be good.After looking at a few, the Park Avenue was decided on, the leather seats were in excellent condition, the floor which was beige was super clean. It had a great body,a little fading near the hood but not bad for a 95 or so I thought, After two weeks I notice it started jerking a little, the third week I called and left a message for the salesman. No return call.
On New Years day on the way home from church the car was jerking so bad I thought we would never make it home after pulling over a couple of times. Talk about embarrassing!So today I called and the receptionist asked who was my salesman and I could not remember his name except he was African American and she said we have several of them(which was true and I understood that) so I called back and told her that his name should be in the computer or my paperwork.
She tranfers me to the finance manager, who says that he can't help me, nor will he fix the car, it's an "AS IS".That it has been two months that I have benn driving the car, actually (1 month and 10 days) I don't have any "As is" paperwork that I signed that was given to me. After looking through my paperwork I found the salesman name Kayode and told him what happened and he said he would speak to his manager and will called me back. TWO hours later he did not call back so I called him , when they transferred my called to him , he picks saying my name and saying he is sorry but his manager said there was nothing they could do that the car is an old car, that it is not new(duh!). I told him you did not say that when I was looking at it, your desciption then was that it was like new,in excellent condition. I'm sorry but it is an old car and it was sold as is.
So now I am stuck with a car I only had for a short amount of time. I am in no position to get it fix right now and I really need a car!

The FTC does not have any such warranty requirement. Each state regulates car dealers, not the FTC. Since you are in NJ, you are most likely referencing NJ state law, not federal law.
I would like you to post the above referenced law here right from the source.

I bought a 1998 Mitusbishi Eclipse Syder from them in 2006. I was smart enough or lucky enough to purchase a extended warranty for 12 month or 12,000 miles. The car was a piece of crap after about 3 months. As a matter of fact, it is in the shop now because the engine is knocking even after being repalced 6 months ago. Anyone who reads this, don't buy a used car from Joe Myers.

Janet, I'm sorry this didn't turn out so well for you, but you did buy a 10 year old car. The Federal Trade Commision requires a dealership to warranty a used car with 0-20,000 miles for 90 days or 3,000 miles, a car with 20,001 to 60,000 for 60 days or 2,000 miles, and a car with 60,001 to 100,000 miles for 30 days or 1,000 miles. A seven year or older car is exempt from this scale, and that car may be sold with our without a warranty.
The entire purpose behind buying an older car is to lessen your expense due to the car being a much smaller price. With that smaller price comes the responsibility of all repairs on the vehicle once it is sold.
If you look on your purchase order, most stores use the same type of form, on the right hand side you'll see two boxes. One box will say something about a warranty and the next will say something along the lines of 'Waiver of Dealer's Obligation'. The 'waiver' box is the as-is disclosure. You should also have signed a FTC guide from the window marked 'AS-IS', but they might not have done that.
You could go through your paperwork and see if anywhere it is disclosed As-Is, and if it isn't you could try to sue them, but honestly, it is a 10 year old car and your chances of winning the case are pretty slim.
Sorry for the situation and I hope you're able to get your car repaired without costing you a lot.
