Re: Information Dispute on my DAC/USIS report.

Dear Sir or Madam,

I am disputing work history #7 K&B Transportation. I may have violated company policy; however I had a very good reason. Throughout my employment with K&B Transportation 12/2007 to 3/2008 my dispatcher Matt was very hateful to me. Matt was so upset because I got caught in an ice storm and the truck had 3 inches of ice on it and would not start even though I was off duty and at home. I bit my lip and went on.

Everyone has a threshold of tolerance and they reached mine when they woke me to pick up loads on 3 different occasions during my DOT breaks. Which is very illegal. Matt would call the truck stop where I was taking my DOT breaks and send truck stop personnel out to my truck to wake me or if they had another driver in the area they would send another driver to wake me up during my DOT break.

I would run day and night for this company illegally because I wanted to keep my job and support my family during Christmas. I did not go home Christmas or New Years. On February 20th, 2008 the last occasion they woke me, my fiance' got wind of it and immediately looked up the telephone number for DOT/FMCSA. She insisted that I report them. The DOT reference number is 26152. She being a driver herself knew that I was tired all the time and was worried about my safety.

After reporting to DOT she insisted I give my 2 weeks notice. I had to wait until February 22nd, 2008 upon depositing my last check in the bank because after they woke me up the second time my girlfriend started doing research about K&B on the internet and discovered that they kept other drivers last paychecks. I didn't want my family to do without because I chose to work for the wrong company.

After I gave my 2 week notice, they gave me shorter runs with layovers which allowed me to get caught up on my sleep some. It so happened they ran me through their terminal in S. Sioux City, NE to pick up a load going to Waterloo, IA. I went inside to take a break before hooking to the load as I was tired and on a layover. This is where I met Ernest whose last name I am unaware of he was originally from St. Louis, MO area.

He shared with me the same identical story waking him up and short runs since he had given his 2 weeks notice. They had sent him everywhere but the terminal. They give him a load to Council Bluffs, IA and then dispatched him the longest load they had ever offered him to Washington State. In efforts to entice him to stay I am sure. He explained to them that he had put his 2 weeks notice in 3.5 weeks ago and he was going home. They threatened to call the police if he came to the terminal out of route.

He told them to go ahead and call the police he did not care, he was going home. A man that plays by the rules shouldn't be treated that way. They tell all their drivers at orientation that if you give 2 weeks notice you will get a bus ride home company paid. Do you think they offered to pay for his bus ride home after threatening to call the police on him? He had to call a cab and then pay for his bus ticket home. His wife was worried about him also.

I was thinking to myself they are doing the same thing to me with the short runs and all that they did to him and if I didn't drop the truck off now I might never make it back through here. Which would force me to abandon the truck and or load in a different state. After hearing his story that is where my tolerance limit was reached. I felt like the situation was getting worse. I called my girlfriend to tell her Ernest's story and she felt that they would do the same to me.

She blew a gasket and convinced me that it was time to quit. She drove from Springfield, MO to South Sioux City, NE to pick me up at our expense 1020 miles round trip. (She has always been supportive of my career choice but she was not comfortable with the way they were pushing me so hard.) I did not want to call them and tell them I had quit.

I wanted to wait until they sent someone out to wake me up on my DOT break for them to discover I was gone. However my girlfriend said that I should do the right thing, (not for them) but for the next driver they were going push hard to get the load to Waterloo on time. She convinced me to call and tell them before leaving their lot which was about 1 AM, on March 1, 2008, that I had quit.

I am not sure which company policy they are claiming I violated, but I can tell you that if I had it to do over again I would have done it the exact same way. I never hooked to the load going to Waterloo, IA and never sent in an acceptance or a pick up complete macro on the Qualcomm going to Waterloo. Therefore how could I have abandoned a load? I cleaned out my truck and swept it out.

I did not leave it dirty. I even took pictures of it when I was through cleaning it because I was anticipating underhanded practices and of course they charged me for cleaning out the truck anyway. I did not think it was worth arguing over when they phoned and called me names and threatened me. I guess the payback was this flaw on my DAC. I appreciate whoever has taken the time to read this.

I hope to clear up this matter. This has affected seeking employment with better companies that will not treat me the way K&B treats their drivers. Thank You. heres another report on a sh*tbag company using drivers for illegal trucking.
soon it will come to pass that all the professional drivers who are being treated so sh*tty will collectively say Hey F*k You!!  and just stop working like this...WE can take control if we all band together

As a former K&B'er, I can confirm everything he said. After many sucessful years working for Schnieder, JBH, and even Swift (although a really bad place to work), unfortunately for me, my DAC is also ruined and I am un-employable now (almost a year) courtesy of K&B. DOT regs and Hours of Service mean nothing to K&B, and they don't take kindly to complaints.

I never worried about the short runs and lack of milage, because of the 2500 mile guarantee (you always got paid for 2500 miles minimum no matter how few miles you drive). Ever wonder why they guarantee a minimum weekly salary of $850 ? The big problem was they couldn't understand that once you go "on-duty", the DOT 14 hour rule starts.

They always wanted 11 hours of driving out of me, even though it would be 3 or 4 hours from here to there, then 5 hours parked, then 3 or 4 more hours from there to here, then 3 or 4 hours parked, then a 5 hour drive over yonder. In their book, 3 + 3 + 5 = 11 DOT driving hours, and I was told to "make it work".

For the mathmatically challenged..... or other exhausted K&B drivers out there, the DOT would call that a 19 hour work shift..... as they are writing you up for the logging violations, the HOS violation, and the 30 hour out of service ticket. By the way, that's also 3 strikes on your MVR too.

Be very careful, Iowa State Troupers know what's going on, and that plain white DOT vehicle sitting at the west-bound IA/NE weigh station is not empty either. I only got caught once, but the IA Trouper said he understood what was going on, and let me go after about an hour, with a complete safety inspection and a warning ticket, no DOT or MVR report (btw, my MVR has been, and remains clean for the past 35 years).

I fussed... and I bitched... and quoted regs to them... and I attempted to educate my dispatcher for weeks. So one day after about 15 hours driving, they kindly told me I could stop at this maintenance shop and pick up a relief driver. As I slept in the back, he drove my truck (and load) back to the K&B terminal.

Back at the terminal late that day, I was woke by a shop guy, who told me to report to my dispatcher. He took me to a small room upstairs, and presented me with photographs of about a half case of some odd-ball BEER suposedly taken in my truck, and pulled out a 12-pk of Miller beer with a few cans missing, and told me that was just taken out of my truck by the shop.

Of course I told them it was bull sh*t, and I wanted a test. Sorry, no test, no recourse, no appeal. They pulled the control breakers and batteries out of my truck, and told me to clean it out over night... in the dark... alone. The next morning, they loaded my 10 boxes of personal effects into a pickup truck, and dropped me and my stuff off on the street corner in downtown Souix City at the bus terminal. Stuck on a street corner with all my stuff 1283 miles from home, no bus ticket, no paycheck for the past week, nothing.

After 6 months filing complaints with the DOL, they finally sent me a statement for my last week working for them -- 96 hours at $5.75/hr (minimum wage, no over time, and yes, that's over 13 hrs driving a day) -- payable in two installments forthcoming. First about a month later, second about a month after that. So as to leave no evidence and to accept absolutely no liability for any of this mess, the checks were issued by "The Great Western Cattle Company".

I've been a licensed driver for over 35 years. I've never had alcohol of any type in any kind of motor vehicle (not even when I was a teenager). There's not even a drop of alcohol of any kind in the house that I'm about to lose, because I haven't been able to get a job for the past year.

Avoid K&B like the plague. Go work for Swift if you don't need the miles or the money, or JBH if you can handle the lies and BS, or even Schnieder (ok miles, usually got a load, very strict on HOS) if you are mechanically inclined and can repair your truck or trailer yourself on the side of the road (they do give you breakdown reflectors, flares, two garbage bags full of spare parts, filters, two gallons of oil, but no spare alternater, starter, transmission, or rear tandem axles).

Well, I guess big trucking companies are always going to screw us, drivers are always going to uselessly b***h and complain, and this is just the way the cookie crumbles. If you can't take it, go be a school teacher.

If anyone cares to do so, and if they were to take the time to search the sheer number of complaints lodged against this company across the web, and even on this site for that matter, one would discover three commonly expressed complaints about this company, and they are very serious complaints.

1.) They wake up drivers routinely to prod them to get down the road, by whatever means necessary to achieve getting him or her up and out of bed;

2.) If a driver dares assert any resistance and threatens to quit, they are well known to contact police under false pretenses, and have even attempted to claim a driver has stolen the truck once or twice, and;

3.) This company absolutely trashes the employment records of people who get fed up with being treated like cattle, when they run for the hills.

This company should be avoided at all costs. It's as simple as that.
