Kellie Auto Sales Bought a truck, got ripped off. Made payments. Owner got incarcerated, I obtained power of attorney over vehicle, missed a payment, and truck was repossessed with no notice. Now they wont give me info Columbus, Ohio

We bought a truck for my son, was put in my fiances name. He became incarcerated, and then I had to move while he was incarcerated. I obtained legal power of attorney over vehicle.
We missed two payments from the time owner became incarcerated and I obtained power of attorney in order to make payments. We never got any payment book, paperwork anything with the truck. I called and notified them that I had power of attorney over vehicle and if they could just give me the amount owed, I could take care of it.
They refused to give me any information, said I had to wait for the "certified letter" to arrive in the mail until I could do anything. So Im headed there tomorrow with the paper and possibly the police to see if I can pay for and get the vehicle back.
I wouldnt think they would want to give a customer that just wants to PAY for the vehicle such a hard time! Especially since there is an active lawsuit against them from the Attorney General for this exact thing!

So the reader can understand you better. You purchased a vehicle for you son, which obviously you nor he could purchase on your own, so you had to take advantage of some unsuspected female. You're calling her your "fiance", because clearly you are no longer with her or you would not have had to obtain "Power of Attorney" just because your son went to "JAIL". The vehicle, according to you was already in your fiance's name.
Then you state that the payments were past due by two (2) months. How would you know that the payments were past due two (2) months if, according to you, "you were never give any payment book,or paperwork for the transaction". Oh, Was that a question?
Then you say that the company refused to inform you of the amount need to redeem the vehicle. But, what you are convienally leaving out is that YOU ARE NOT THE OWNER!!!. The lender did not do business with you nor your son, they did the business with your "Fiance" and any "Right to Cure" notices would go to her.
It is always best to know the facts before you play the victim role. At the very best, you and your son knew what you were up to. and at the very least, you and your son took advantage of an unsuspecting female.
SHAME ON YOU BOTH!!!!!!!!!!

My guess is the bank that financed the truck got wind of the incarceration of the financed party and disqualified him for the loan, which resulted in a repo. To a bank a debtor being incarcerated is the same as a debtor losing his job because it deprives him of his income.
You having power of attorney over the truck allows you to use, insure, register and tag it but it doesn't make you the beneficiary of the loan attached to it. Now that it has been repossessed the dealer would likely try to sell it to you instead, since you are obviously interested, which would give you clear title.
